„ A <br />City of ORONO <br />� RESOLUTION OF THE CITY COUNCIL <br />NO. -- <br />D) 6500 squpre feet of additional area is provided in Lot 1, <br />Block 4 , Minnetonka Summit Park, although cannot be credited <br />against the area requirements because the lot is divided by the <br />unimproved right-of-way of Ridge Place. <br />4. The City Council has considered this application including the <br />findings and recommendations of the Planning Commission, reports by <br />City staff, comments by the applicant and the effect of the proposed <br />variance on the health, safety and welfare of the community. <br />5. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />prcperties in this zoning district; that granting the aariances would <br />not adverse_y affect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring properties; would not merely <br />serve as a convenience to the applicant, but is necessary to <br />alleviate a demonstrable hardship or difficulty; is necessary to pre- <br />serve a substantial property right of the applicant; and would be in <br />keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the C'ty. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City <br />Council !ereby grants variances per Municipal Zoning Code Section 10.24, <br />Subdivision 5 (B) to confirm the buildability of the property that requires <br />an area variance of 43% and a lot width variance of 46%, s ict to the <br />following conditions. <br />1. Lot 1 and Block 5 must be legally combined prior to the <br />issuance of a tu, Wing permit for new ^.onstruction. <br />2. If accessory structures are proposed fo Lot 1, Block 4, <br />Minnetonka Summit Park, at :-ome time in the futur.., the owner must <br />apply for a special lot co,abination to seek credit of the principal <br />residence on combined sots 1 and 2. <br />3. Future owner is placed on notice that no variance wi'1 be granted <br />for t1.e residential development of this property based on this current <br />review which found no diffic;.lties with the physicai development of <br />this site. <br />4. Access to the site shall remain via the pr i vale 'rive located <br />within the public dedicated right-of-way and to coneinuA tc be <br />maintained by the property owners served by suc', driveway.
