The special conditions applying to the structure or land in question are peculiar to such <br />property or immediately adjoining property: <br />The owners propose the addition near the garage to allow for reasonable access. All of the current <br />bedrooms are on the second story limited the access to the garage with the stair. The irregular <br />shape of the parcel and the location of the current home is unique to the site. The addition is <br />proposed on the lake side of the house, furthest from the lakeshore, to minimize impacts. This <br />criterion is met. <br /> <br />9. The conditions do not apply generally to other land or structures in the district in which the <br />land is located: <br />Although the property has a unique shape and shoreline, the house has a restrictive building <br />envelope where expansions are challenging. This criterion is met. <br /> <br />10. The granting of the application is necessary for the preservation and enjoyment of a <br />substantial property right of the applicant: <br />The existing house creates a limited building envelop on the property. The proposed addition is <br />minimal to the site and has provided support that the addition should not have an impact on lake <br />views preserving the intent of the ALS standard. This criterion is met. <br /> <br />11. The granting of the proposed variance will not in any way impair health, safety, comfort or <br />morals, or in any other respect be contrary to the intent of this chapter: <br />The ALS is in place to protect the existing views of the lake over the subject property from the <br />adjacent home. There has been evidence provided that indicate lake views will not be impacted, <br />and that the addition has been sited appropriately to mitigate adverse impacts to others. This <br />criterion is met. <br /> <br />12. The granting of such variance will not merely serve as a convenience to the applicant but is <br />necessary to alleviate demonstrable difficulty: <br />Staff finds the granting of the requested variance would be reasonable, and that the addition has <br />minimal impacts on adjacent properties and lake views. This criterion is met. <br /> <br />The Commission may recommend or Council may impose conditions in granting of variances. Any <br />conditions imposed must be directly related to and must bear a rough proportionality to the impact <br />created by the variance. No variance shall be granted or changed beyond the use permitted in this <br />chapter in the district where such land is located. <br /> <br />Public Comments <br />The applicant has submitted letters in support of the request from the adjacent neighbor (850 <br />Partenwood Road) and the Partenwood Homeowners’ Association Architectural Committee. <br /> <br />Planning Staff Recommendation <br />Planning Staff recommends approval as applied. <br /> <br /> <br /> <br /> <br /> <br /> <br />92
