The <br />applicants have requested variances to construct a new home. The <br />new home footprint is proposed to encroach approximately one <br />foot into the rear/street setback, 10 feet lakeward of the 75-foot <br />lake setback, and the 2nd story balcony encroaches 14.3 feet <br />lakeward of the 75-foot setback and approximately 3 feet into the <br />average lakeshore setback. On the rear, an approximate 3 square <br />foot triangle of the home footprint is proposed to encroach into the <br />30-foot rear yard setback by ±one foot. Also requested are <br />variances for hardcover to permit 31.5% hardcover overall, where <br />the current level is 31.9% (where 25% is permitted); a 232 square <br />foot reduction in hardcover is proposed within the 75-foot setback <br />area. Because of the need for the above variances, lot area and lot <br />width variances are also required. <br /> <br />Due to the low, flat elevation on the property, they are proposing <br />to elevate the home on fill, which requires a 15-foot-wide <br />perimeter rescue-bench elevation of at least 931.5’ around the <br />home. The property width limits their ability to achieve the 15-foot <br />bench; therefore, a CUP is also required. <br /> <br />Practical Difficulties Analysis <br />Applicant Submittal Information: The applicant has identified the <br />substandard area and width of the lot as practical difficulties <br />supporting the requested variances. Additionally, they have <br />provided supporting documentation regarding Practical Difficulties <br />Application Summary: The applicant is requesting the following variances to redevelop the property with a new <br />home: <br />1. Lot area variance. <br />2. Lot width variance. <br />3. Rear yard setback variance. <br />4. Average lakeshore setback variance. <br />5. 75-foot lake setback variance. <br />6. Hardcover exceeding 25%, and <br />7. Hardcover within 75 feet of the OHWL. <br /> <br />A conditional use permit is also required to deviate from the 15-foot perimeter rescue bench required for the <br />home to be elevated out of the floodplain on fill. <br />Staff Recommendation: Planning Department Staff recommends approval. <br />9 <br />PC <br />Exhibit A
