FILE # LA25-000024 <br />18 August 2025 <br />Page 6 of 6 <br /> <br /> <br />13) Designed to take into account the natural, scenic, and historic features of the area and to minimize <br />environmental impact; the overall long-term effect of the project should result in minimal or no <br />environmental impacts. <br />14) All exterior lighting shall be so directed so as not to cast glare toward or onto the public right-of-way or <br />neighboring residential uses or districts; this project should result in no additional non-residential lighting or <br />glare; and <br />15) Not detrimental to the public health, public safety, or general welfare. The project should not be a detriment <br />to public health, public safety, or general welfare. <br />A CUP may be granted subject to such conditions as the Council may prescribe. Additionally, a CUP shall remain in <br />effect as long as the conditions imposed by the City Council are observed, but nothing in this section shall prevent the <br />city from enacting or amending official controls to change the status of conditional uses. <br /> <br />Public Comments <br />Letters in support of the applicant’s request have been received and are attached as Exhibit I. <br /> <br />Analysis <br />To allow more room for grading on the narrow lot, the applicants have not fully utilized the building envelope by <br />increasing the width of the home as close to the side lot lines as the 7.5-foot setbacks would permit. Rather, they’ve <br />made minimal improvements to the encroachments on the lake and street sides, requiring variances. The applicant’s <br />plan is sensitive to massing and open space, providing approximately 2.5 to 3 feet of additional setback (open space) <br />on both side yards, does not maximize the allowed footprint, and does not maximize the height. Staff conducted a <br />cursory review of the proposed building height, and the home will be approximately 22 feet in height(as defined), 8 <br />feet lower than permitted. <br /> <br />The applicants’ plan reflects a deviation from the 15-foot rescue bench requirement, which is reasonable <br />considering the narrow width of the property. As part of this project, all building permits, the applicants will be <br />required to install erosion/perimeter control to prevent impact on the neighboring properties. Additionally, they <br />shall keep debris off the public roadways. Correction of any damage to the public roadways will be required to be <br />completed as part of the building permit compliance. <br /> <br />Issues for Consideration <br />1. Does the Planning Commission find that the property owner proposes to use the property in a reasonable <br />manner that is not permitted by an official control? <br />2. Does the Planning Commission find that the variance(s), if granted, will not alter the essential character <br />of the neighborhood? <br />3. Does the Commission find it necessary to impose conditions to mitigate the impacts created by the <br />granting of the requested variance(s)? <br />4. Are there any other issues or concerns with this application? <br /> <br />Planning Staff Recommendation <br />Planning Staff recommends approval as applied, conditioned upon any forthcoming requirements from the MCWD and <br />City Engineer. <br /> <br /> <br />14
