Mabusth, Building & Zoning Administrator <br />Date: February 10, 1988 <br />Subject: #1242 Kathy & Andy Duncanson, 690 North Brown Road - <br />Conditional Use Permit - Public Hearing <br />Zoning District - RR-lB, 2 acre minimum density <br />Total Area = 25+ acres <br />Pertinent Ordinances - Ordinance 29, Second Series, approved 1/23/87; <br />Section 10.02, Definition of Guest Apartment; Section 10.20, <br />Subdivision 3 (G). <br />List of Exhibits <br />Exhibit A - Application <br />Exhibit B - Property Owners List <br />Exhibit C - Plat Map <br />Exhibit D - Floor Plan (Lower Level Apartment) <br />Exhibit E - Elevations <br />Exhibit F - Site Plan <br />Exhibit G - Ordinance 29, Second Series <br />The applicants were issued a building permit subject to the condition <br />that an appropriate land use application be applied for to permit the non - <br />rental apartment prior to the issuance of the permanent certificate of <br />occupancy. The Building Inspector has advised that he did not permit the <br />installation or completion of the kitchen unit area until the land use <br />application was approved. The applicants were issued a temporary <br />certificate of occupancy in August of 1987 pending resolve of the land use <br />application. The applicants seek a conditional use permir� for a non -rental <br />apartment within the. r principal residence for the use of a housekeeper. <br />Primary access to the apartment is via the principal dwelling. Note access <br />is via a finished recreation area serving principal residence. Review <br />elevation of north side (Exhibit E) that shows secondary exterior access <br />via the sliding glass doors. The 25+ acre site will provide adequate area <br />for the additional parking unit for the guest apartment. The existing <br />septic system is adequate to serve the additional demands of the bedroom <br />and kitchen area. <br />The City will not assign a separate address for the apartment unit nor <br />has a separate utility meter been assigned to the house. <br />Staff Recommendation - <br />To recommend approval of a conditional use permit application for a <br />non -rental caretaker apartment for Kathy and Andy Duncanson, the owners of <br />the principal residence located at 690 North Brown Road, finding all <br />Pertinent standards of Section 10.20, Subdivision 3 (G) have been <br />satisfied. Applicants/future owners are further placed on notice that the <br />second dwelling unit within the principal residence can never be rented and <br />any future expansion of the non -rental apartment or modification of floor <br />plan with a suggested intensification of use must be approved by the City <br />
