City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />5) The proposed improvement will be in keeping with land <br />use plans and planning objectives for the City and will not <br />increase or cause danger to life o:- property. <br />6) The proposed improvement will be consistent with the <br />objectives of encouraging land uses compatible with the <br />preservation of the natural land forms, vegetation, and the <br />marshes within the wetlands. <br />3. The City Council finds that the conditions existing on this pro-- <br />perty are peculiar to it and do not apply generally to other property <br />in this zoninq district; that granting the variances would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring properties; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demon- <br />strable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the <br />spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />4. The City Council finds that granting a conditional use permit to <br />allow the land alterations as proposed will not be detrimental to the <br />health, safet;X or general welfare of the public, would not adver- -y <br />affect light, air nor pose a fire hazard or other danger :o <br />neighboring properties, nor will it depreciate surrounding property <br />values and that the proposed level of use of the property will be in <br />keeping with the intent and objectives of the Zoning Code and <br />Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City <br />Council hereoy grants variances to Municipa' "-n4ng Code Section 10.55, <br />Subdivision 8 approving the encroachment of re, !d setbacks for specific <br />land alterations and activities noted above L rants a conditional use <br />permit per Section 10.03, Subdivision 19 for all land alterations in excess <br />of 100 cubic yards also noted above, subject to the following :onditions: <br />1. The applicant shall work closely with the City to provide adequate <br />erosion control during the entire project. <br />2. All land alterations involving adju:snt properties that exceed 100 <br />cubic yards of fill will require the separate filing of cc-dit? ona 1 <br />use permits with the City of Orono. <br />Page 3 of 4 <br />
