Dear <br />It has been quite some time since we have discussed the <br />restoration to the shoreline and road adjacent to your <br />properties. <br />I have just recently been advised that Minnetonka Beach is <br />not interes�c d in closing the road. Therefore, it would appear <br />that the only option available is to restore the shoreline, <br />nbankment, and street to its original condition. <br />In order to accomplish this, it must be determined who will <br />be responsible for the ccsts of the repairs. <br />As you are all aware, the City does not have any <br />documentation showing ownership by the City of any street iight- <br />of-way through your properties, other than twenty plus years of <br />maintaining the improved portion of the street (the paved area). <br />It would seem appropriate for the property owners to grant street <br />right-of-way easements to the City at this time. For discussion <br />purposes, it is sugges =ed that easements be given to the City <br />for the paved area plus ten (10) feet on each side of the <br />pavement. <br />It must also be de -:ermined whether or not this will be a <br />joint restoration project or each property owner contracts for <br />their own and the City contracts for its own. <br />If everyone agrees that it should be one project with the <br />costs divided among the affected properties, then the first step <br />would be to provide with a feasibility study. <br />The feasibility study will better qualify the different <br />options available to perform the restoration and an engineer's <br />estimate of the cost to each property owner. <br />
