C) The structure will be installed on a parcel of land <br />consisting of 140+ acres of contiguous lands. <br />D) The structure will be partially screened by the existing <br />topography and adjacent trees providing natural screening the <br />majority of the year. <br />5. The City Council finds that the conditions existing on this pro- <br />perty are peculiar to it and do not apply generally to other property <br />in this zoning district; that granting the variance would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring properties; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demo,l- <br />strable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; ar,] would be in keeping with the <br />spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />6. The City Council finds that granting a conditional LSE permit to <br />allow the installation of an accessory structure will not be <br />detrimental to the health, safety or general welfare of the public, <br />would not adversely affect light, air nor pose a fire hazard or other <br />danger to neighboring properties, nor will it depreciate Eurrounding <br />property values and that the proposed level of use of the property <br />will be in keeping with the intent and objectives of the zoning Code <br />and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City <br />Council hereby grants a conditional use permit per Municipal Zoning Code <br />Section 10.20, Subdivision 3 (C) to allow the construction of an accessory <br />structure to serve as a storage facility for the Country Club and grants a <br />building area variance of 1,704 s.f. or 170% for the storage structure that <br />will exceed the allowed building area of 1,000 s.f., subject to the <br />following conditions: <br />1. At the time of appl,carion for a building permit for the accessory <br />structure, the applicant must submit an accurate survey locating the <br />proposed structure and designate the size of the structure. The <br />existing temporary sheds adjacent to the proposed structure on the <br />north side of the Luce Line are to be removed upon completion of the <br />storage facility. <br />2. Applicant is further advised that the filling of the former burn <br />site to the immediate west of the currently used burn site is not an <br />approved land alteration by the City and that if applicant chooses to <br />install a berm of similar height and size, that the City will require <br />a separate conditional use permit.
