City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />B) Execution of a Flowage & Conservation Easement over the pond <br />and swale (legal description for easement to be provided by <br />City). <br />C) Grading plans for pond/swale and additional filling adjacent <br />to drainfield area designating proposed and existing contou_rs9 <br />Applicant is limited to the use of spoils removed from pond an <br />swale excavation. <br />D) Execute a permanent Hold Harmless Agreement for the proposed <br />land alteration. <br />2. Applicant must apply for the renewal of the original M.C.W.D. <br />permit. <br />3. The disturbed areas shall be re -vegetated as soon as possible <br />following the completion of the grading work. <br />4. All fill to be transported from site shall be conducted during the <br />daily time period beginning at 7:30 a.m. to 5:30 p.m., " .nday througl. <br />Friday or:ly. <br />5. Authorities granted by this conditional use permit run with the <br />property not with the applicant, but are permissive only and must be <br />exercised by application for a land alteration permit within one year <br />of the date of Council approval, or this conditional use permit will <br />expire on that date (February 8, 1989). <br />6. Violation of or non-compliance with any of the terms and condi- <br />tions of this resolution shall constitute a violation of the zoning <br />code. shall automatically terminate any authority -granted herein, and <br />shall be punishable as a misdemeanor. <br />7. The undersigned applicant has read, understood and hereby agrees <br />to the tPrmG of this resolution and on behalf of himself, his heirs, <br />successors and assigns, hereby agrees to th­� recording of this <br />resolution in the cha4.n of title of the property. <br />1988.
