§ 5.40 <br />( SEC. 5.40. HOME OCCUPATIONS. <br />Subd. 1. License Required. It is unlawful for any <br />person to engage in, or carry -on, a home occupation, as that term <br />is defined in the Zoning Chapter of the City Code, without first <br />having obtained a license therefor from the City. <br />Subd. 2. Regulation. Licenses will only be issued if <br />the specific use is permitted or otherwise allowed by the Zoning <br />Chapter, and if all conditions set forth in said Chapter are fully <br />complied with. <br />SEC. 5.41. MACE. <br />Subd, 1. License Required. It is unlawful for any <br />person to sell or distribute, at wholesale or retail, the substance <br />commonly referred to as mace, without first having obtained a <br />license therefor from the City. <br />Subd. 2. Limitations. <br />A. Only persons who are duly authorized and <br />licensed Federal firearms dealers shall be licensed. <br />B. This Section shall not apply to official sales <br />to, or purchases from, the City Police Department. <br />SEC. 5.42. BUSINESS AND JOINT USE OF LAKE FACILITIES. <br />Subd. 1. Definitions. For the purpose of this Section, <br />the following terms have the meanings given them: <br />A. "Boat Slip, Water" means a structure, space, <br />dock or othof,thing designed or used for the docking, mooring or <br />storing of a boat temporarily or permanently in or on water, <br />including mooring posts, buoys or other devices. <br />B. "Boat Slip, Land" means a structure, space or <br />other thing designed or used for storing a boat temporarily or <br />permanently on land adjacent to a lake, whether it is located on or <br />off the licensed premises. <br />C. "Business of Docking, Mooring, or Storing Boats" <br />means renting or otherwise providing space, including boat buoys, <br />for docking, mooring or storing three or more boats helonging to <br />persons other than the owner or occupant of the property. <br />D. "Commercial Boat Dock Business" means providing <br />space for docking, mooring or storing boats for a fee, or boats <br />used in a trade or business, including, without limitation, provid- <br />ing rented spaces, boat buoys, space for keeping boats owned by the <br />licensee and held for sale, display, rental, or otherwise used in <br />connection with a boat or marina business, and space held for <br />(. dockinq of boats during_ or pending repairs or maintenance of said <br />boats. <br />ORONO CC 126 (4-1-94) <br />
