4.02 The Fire Customer hereby agrees to pay to the City of Maple <br />Plain as additional Annual Consideration, any debit adjustment <br />calculated hereunder and the City of Maple Plain hereby agrees to <br />reimburse to the Fire Customer any credit adjustment calculated <br />hereunder. <br />TERMINATION <br />5.01 This agreement shall commence on the first day January 19 <br />and remain in full force and effect during the calendar year of <br />it s commencement and three full calendar year thereafter. It <br />shall automatically renew each calendar year thereafter unless <br />canceled by any party. Such cancellation shall bE effective for <br />the calendar year next succeeding the year during which notice of <br />calcellation is given, only if the party desiring t.) cancel serves <br />written notice upon the other party on or before August 1 of the <br />last calendar year of operation of the agreement. <br />MISCELLANEOUS PROVISIONS <br />6.01 In case of concurrent fires, either within the several areas <br />served by the City of Maple Plain or under any Mutual Aid Agreement, <br />the Fire Chief of the City of Maple Plain shall weigh the relative <br />risk of loss to life and property posed by the concurrent fire% nd <br />shall make a final determination on the advisability of committing <br />equipment and fire fighters to the concurrent fires. In making <br />this determination, and in making the same determination in the case <br />of sing;` fires, the Fire Chief shall also consider the feasibility <br />of making the fire run in light of road conditions, weather conditions <br />and all other conditions which shall effect the safety of fire <br />fighters and equipment. <br />
