I <br />TO: Mayor and City Council <br />FROM: Mark Bernhardson, City <br />DATE: October 6, 1987 <br />10787.10 <br />Administrate ��tV <br />SUBJECT: Administrator's Information <br />3536 LYRIC AVENUE - The resident continues to do some work in <br />putting a foundation under the property, however the work is not <br />completed and staff will be further monitoring this project for <br />hopefully having a completion within the next month. <br />1972 SHADYWOOD ROAD - At the pre-trial hearing on September 29, <br />1987 the attorney for the resident and the attorney for the City <br />attempted to see if there was some common ground for a negotiated <br />settlement that would cease the feeding of the ducks for here <br />forward. At the time it did not appear that the resident was <br />amenable to a negotiated settlement and it was agreed that the <br />attorneys would a: Sue the status of the stipulation in light of <br />the prohibition on feeding the ducks that was passed subsequent <br />to that stipulation, The Judge agreed to that and gave the <br />defendents a month to submit a brief on that matter giving the <br />City two weeks after that to respond. It is anticipated that a <br />ruling on this matter will not be received until November or <br />December. <br />394t SIXTH AVENUE NORTH - Despite promises by the owner no <br />progress Fias been na3e end the City will be having its contractor <br />initiate work on the property within the next week. <br />2160 WAYZATA BOULEVARD - The PCA did transmit the letter to the <br />owner indicating certain actions that he must take and <br />deadlines that he must meet with the feel inci of the PCA at this <br />point being that the owner of the property is responsible based <br />on the assumption that the pollution is coming from his property. <br />In a discussion with the property owner he feels that the origin <br />of the pollution is not on his property and that he will be <br />working with PCA through his attorney on the matter. <br />200 HOLLANDER ROAD - There is presently no further progress on <br />the matter to report since last time. The representative from <br />the estate has not been in contact with the City regarding <br />possible voluntary development of the by-laws for the homeowners <br />association as had been hoped. The clean-up on the property has <br />not substantially changed since work earlier this summer. The <br />City will be continuing to resolve the barn issue and clean-up <br />during the next month or so. <br />3405 SHORFL_INE ' IVE - During the past month tte staff in <br />conjunction with ;iennepin County has reviewed the location of a <br />new road and sidewalk again for the owner of the property. It <br />was hoped that this would al low him to make up his mind regarding <br />the amount that he would have left for parking and balance that <br />
