� _ <br /> � <br /> � Cit� o� ORONO <br /> • RESOLUTION OF THE CITY COUNCIL <br /> • <br /> NO. 1266 <br /> • • • A RESOLUTION APPROVING A CONDITIONAL USE <br /> PERMIT FOR ROBERT SKINNER AND FRED HINTZE <br /> FOR A RESTAURANT LOCATED IN A SECTION OF THE <br /> EXISTING BUILDING AT 3416 SHORELINE DRIVE <br /> WHEREAS, the City of Orono is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; and <br /> WHEREAS, pursuant to State Statutes 412 et. seq. and 463 et. <br /> seq. , the City Council of the City of Orono has adopted zoning <br /> regulations for the protection of the public health, safety and <br /> welfare; and <br /> WHEREAS, pursuant to Section 35 .024 of the Orono Zoning <br /> Code, Robert Skinner and Fred Hintze have applied for a conditional <br /> use permit to operate a restaurant in the existing "multi-use" , <br /> commercial structure at 3416 Shoreline Drive; and <br /> WHEREAS, after review of the Planning Commission and City <br /> • staff, the City Council hereby mdkes the following findings of fact: <br /> 1. The proposed restaurant will occupy no more than 324 sq. <br /> ft. of area within the existing building known as The <br /> House of Carpets. <br /> 2 . The restaurant will offer "carry-out service" only, <br /> offering a limited menu of pizza, pasta and deli <br /> sandwiches. <br /> 3 . The two applicants plan to operate the restaurant and <br /> to be assisted by two part-time employees. <br /> 4 . The proposed hours of operatian are 11:00 A. M. to <br /> 11:00 P.M. , Sunday through Thursday and 11:00 A. M. to <br /> 12 :00 A. M. Friday and Saturday. <br /> 5. Five parking stalls located on the west side of the <br /> building shall be reserved for restaurant use. A sign <br /> shall inform customers of additional parking available <br /> in the municipal parking lot to the rear of the building. <br /> 6 . The preliminary working plans submitted with this <br /> application have been reviewed and approved by the <br /> Building Inspector and the Planning Commission per <br /> • Section 35.002 of the Orono Zoning Code . <br /> 7 . The proposed use of signage for the restaurant satisfies <br /> code requirements of Section 38 .031. <br /> PAGE 1 OF 2 <br />
