L> > <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1487 <br />CONCLUSIONS, ORDER AND CONCITIONS <br />Based upon the above findings, the Orono City Council hereby grants <br />a variance to Zoning Ordinance 31.983 and grants a Conditional Use <br />Permit as required per Zoning Ordinance 31.700 to permit the excava- <br />tion of thelakeshore bank, portions of which are located within 75 <br />feet of the lakeshore subject to the following conditions: <br />1. Stakud hay bales and a fabric silt fence must be used for <br />erosion control during ccnstruction and until vegetatir- <br />is established. <br />2. Staff must be notified prior to second phase of land alteration <br />(lakeshore bank excavation) in order to assur! proper erosion <br />control devices have been installed. <br />3. The boat house located on the lakeshore of the property has <br />been inspected by staff on May 10, 1983 and found to be in <br />excellent condition. The structure is a non conforming <br />structure and subject to all pertinent municipal ordinance. <br />4. No other variances are granted or permitted for this <br />application. <br />5. Violation of or note -compliance with any of the terms and <br />conditions of this resolution shall constitute a violation <br />of the Zoning Code, shall automatically terminate any <br />authority granted herein, and shall he punishable as a <br />misdemeanor. <br />E. The undersigned owner has read, understood and hereby agrees <br />to the terms of this resolution and on behalf of himself, his <br />heirs, successors and assigns, hereby agrees to the recording <br />of this resolution in the ch,-ii 3f title of the property. <br />Adopted by the Orono City Councii on this 23rd Say of May, 1983. <br />ATTEST: <br />lber4'a M.
