t <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. -- <br />A RESOLUTION ORDERING ABATENENT <br />OF HAZARDOUS BUILDING ACTION AT <br />1950 SHORELINE DRIVE, ORONO <br />CABIN 2 - WEST EDGE OF LOT <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and I <br />WHEREAS, Gerald Toberman of Shelard Tower, Minneapolis, MN is the <br />fee owner of record of the property located at 1950 Shoreline Drive, <br />Orono, Minnesota, herein referred to as "the property", and legally <br />described as follows: <br />P.I.D. 10-117-23 42 0012 Lots 22 and 23 and that part of Lakel <br />Street lying between the extensions of the side lines of s-_:id <br />lots and between the front line of said lots and NorthwestErly <br />line of the right-of-way of County Road No. 7 Lots 22 and ?3, <br />"Ora Park on Lake Minnetonka", Hennepin County, Minnesota, <br />(hereinafter "the property"); and <br />WHEREAS, the City Council of the City of Orono, having duly <br />considered the matter pursuant to Minnesota Statutes Sections 463.15 to <br />463.261, hereby finds that the above described property is uninhabitable <br />and contains unsanitary and hazardous conditions which constitute a public <br />nuisance and which makes this property hazardous to the public health, <br />safety and welfare based on the following findings: <br />INTERIOR <br />Basement <br />1. foundation - Appears footing and foundaticn do not extend below <br />fros-: line. UBC 29C7(a). <br />First Floor <br />2. Walls - No access inside building. <br />EXTERIOR <br />3. Exterior walls - North wall in contact with earth, no protection <br />from rotting. UBC 2516(c)7. <br />4. Doors - Door on south side has no landing or stair. UBC 2516(c)l. <br />5. Chimney - Chimney is pulling away from structure. Flashing is <br />bad. UBC 3703. <br />6. Accessory Buildings - Deck and front entry stairway rotting and <br />deteriorating, improper lumber used. <br />Page 1 of 3 <br />
