� Cit of ORONO <br /> • <br /> � <br /> RESOLUTION OF THE CITY COUNCIL <br /> � NO. 1227 <br /> • � • • <br /> A RESOLUTION MODIFYING RESOLUTIONS #1198 <br /> AND #1210 AND ATTACHED ASSESSMENT ROLLS <br /> FOR SEWER PROJECT 80-1 AND 80-2 <br /> WHEREAS, pursuant to proper notice duly given as required <br /> by law, the City Council has met and heard and passed upon all <br /> objections to the proposed assessment for the designated sewer project <br /> of Minnetonka Bluffs, West Ferndale , Orono Lane, and County Road #15 <br /> area (80-1) and Scotch Pine Lane , North Shore Drive (80-2) ; and <br /> WHEREAS, the City Council has approved an assessment roll <br /> attached to Resolution #1198 on September 8 , 1980 , as modified by <br /> reductions on October 8 , 1980 , as set forth in Resolution #1210 ; and <br /> WHEREAS, the City has now apparently received or will receive <br /> all temporary and permanent easements needed, and apparently has <br /> received or will receive settlements for all assessment appeals filed <br /> to date involving the marina areas, and the City Council therefore <br /> desires to pass those savings on to the affected property owners; and <br /> • NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br /> CITY OF ORONO, MINNESOTA: <br /> l. The original assessment, a copy of which is attached <br /> to Resolution #1198 and made a part thereof, and as amended in <br /> part by Resolution #1210 , is hereby amended by reducing the <br /> special assessments for certain properties to the lesser amounts of <br /> shown on Exhibit A attached hereto. The lesser of the amounts of <br /> special assessment for each property shall constitute the special <br /> assessment against the lands named therein, and each tract of land <br /> therein included is hereby found to be benefited by the proposed <br /> improvement in the amount of assessment levied against it. <br /> 2 . Such original assessment and reduced assessments shall <br /> remain payable in equal annual installments extending over a period <br /> of 15 years. The first of the installments to be payable on or <br /> before the first Monday in January, 1981, and shall bear interest <br /> at the rate of 9-1/2 percent per annum from the date of the adoption <br /> of this assessment resolution. To the first installment shall be <br /> added interest on the entire assessment from the date of the <br /> September 8 , 1980 , resolution until December 31, 1980 . To each <br /> subsequent installment when due, shall be added interest for one year <br /> on all unpaid installments. <br /> • <br />
