Resolution No. /D�9y � � <br /> .''• Page 38 <br /> 1. 5023 Structures in Public Waters : "It is the policy <br /> of the Department to discourage the waterward occupation � <br /> of the becls of public waters by offshore navigational <br /> facilities , retaining walls , and other structures in order <br /> to preserve the natural character of public waters and <br /> their shorelands , and provide a balance between the protection <br /> and utilization of public waters ; and to encourage the <br /> removal of existing waterway obstructions which do not <br /> serve the public interest from the beds of public waters <br /> at the earliest practicable date. The placement of <br /> ' structures in public waters shall not be permitted where . <br /> the structure: � <br /> • � 1. Is intended to gain access to navigable water <br /> depths where such access can be reasonably attained <br /> . by al�ernative means . <br /> 2. Will obstruct navigation and/or create a water . <br /> safety hazard. <br /> 1, 3. Will be detrimental to significant fish and wildlife <br /> habitat, or protected vegetation. Construction is <br /> prohibited in posted fish spawning areas . " <br /> Permanent docks ". . . . . . . shall extend lakeward only to a <br /> navigable depth (generally considered to be no greater than <br /> four (4) feet) . " <br /> � b. ) Standards and Criteria for the Management of Municipal <br /> Shoreland 'Areas of Minnesota NR82: - <br /> NR83 Land Use �ontrol Provisions : <br /> a . ) Land Use Designa�tion: �:"The development of shorelands <br /> of public waters shall be coi�trolled by means of land use <br /> zoning districts whi�h are designated to be compatible with <br /> the classes of public waters set forth in NR82 (f) . Land <br /> use zoning districts shall be established to provide for: <br /> 1. The management of areas unsuitable for development <br /> ' due to wet soils , steep- slopes , flooding, inadequate <br /> drainage, severe erosion potential, or any other feature <br /> likely to be harmful to the health, safety or welfare of <br /> � � the residents of the community. <br />
