The City Council many times requested that North �hore <br /> Drive Marina submit a revised 1979 Commercial Dock License <br /> Application addressing the specific items of non-compliance <br /> noted above. North Shore Drive Marina has failed to revise <br /> its plans in conformity with these requests and therefore <br /> the existing docks and marina operation remain in violation <br /> of City and LMCD ordinances . <br /> 9. At the specific request of the applicant, City Council <br /> action on this application has been repeatedly deferred <br /> all year long to allow the applicant additional time to <br /> submit evidence, to amend his application, or to supply <br /> any new facts or arguments toward convincing the City and/or <br /> the LMCD to change their long standing interpretation of <br /> the definition of "shoreline" and/or the basic intent <br /> of the City and LMCD ordinances. No new information or <br /> arguments have been forthcoming and the City and LMCD <br /> have declined to change their interpretation of the <br /> Ordinances. The City has no recourse but to deny the <br /> application as presented as being in violation of the law. <br /> 10 . Any docks or marina operation in violation of the <br /> • Ordinances of the City or the LMCD are contrary to the <br /> adopted comprehensive plan and policies of the City as <br /> summarized in this Resolution. <br /> Adopted by the City Council of the City of Orono at their <br /> meeting on the ?.7 day of rdovermber , 19 79 <br /> �1 <br /> � <br /> William B.
