k 'f.: <br />K\ , <br />B; There is an area of rock and plastic of <br />approximately 231square feet in the 0-75* zone (per <br />applicants' hardcover calculation) that can easily be <br />removed to compensate for the additional structure in <br />the 0-75* zone. The additional structure is completely <br />in the 0-75* zone but does not in and of itself <br />increase hardcover on the property since it is over an <br />existing hardcovered deck area. <br />C) The proposed addition continues the existing east <br />and south lines of the house, squaring off the house, <br />and encroaches no closer to the shoreline than existing <br />portions of the house, which are 56* from the <br />shoreline. The proposed additions do not encroach past <br />the defined average lakeshore setback line. <br />4. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports oy City staff, comments by the <br />applicants and the effect of the proposed variances on the <br />health, safetyand welfare of the community. <br />5. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variances would not adverselyaffect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to <br />alleviate a demonstrable hardship or difficul&y; is <br />necessary to preserve a substantial property right of the <br />applicants: <ind would be in keeping with the spirit and <br />intent of th* Zoning C».de and Comprehensive Plan of the <br />City. <br />CONCLUSIONS, ORDBR AND CONDITIONS <br />Based upon one or more oi the findings noted above, the <br />Orono City Counci hereby grants variances to Municipal Zoning <br />Code Section 10..^ Subdivisions 1 & 2 and Section 10.55, <br />Subdivision 8 t^ rmit the construction of a room addition <br />located entirely .^in the 0-75* lakeshore setback zone where no <br />hardcover or stiucture is normally allowed, subject to the <br />following conditions: <br />Page 2 of 5
