5. Dedication to the City of a Flowage & Conservation <br />Easement providing for limitations on the use of wetlands <br />and/or drainageways described therein and shown on the plat <br />as drainage easements. The said easement shall include <br />wetland areas in favor of the City of Orono already granted <br />in earlier easements dated October 4, 1978, Document <br />1298185. <br />6. Execution of a Subdivider's Agreement providing for the <br />installation of certain improvements as a condition of <br />subdivision approval. <br />7. Payment to the City of a Park Dedication Fee in the <br />amount of $400.00. <br />8. Payment to the City for the legal review and filing of <br />the plat e isements and covenants i.i the aunount of $150.00. <br />MOWr THBRKFORB, BE IT RESOLVED that the City Council of <br />the City of Orono hereby approves the plat of Foxwood Second <br />Addition, Hennepin County, Minnesota and further grants width <br />variances to Lots 2 and 3, Block 1, Foxwood Second Addition as <br />lots do not meet the required width at the 50* front setback <br />line; subject to the following condition: <br />1. Access to Lots 1, 2 and 3, Block 1, Foxwood Second <br />Addition must be via Gander Hoad. No direct access onto Fox <br />Street is allowed. <br />2. The aforesaid plat shall be filed by the City of Orono <br />with either the Hennepin County Recorder's Office or the <br />Registrar of Titles Office on or before May 27, 1990 <br />together with a ctrtlfied original copy of this Resolution <br />and executed copien of the easements and covenants noted <br />above . <br />The approval granted by this Rw^solution shall expire if <br />the plat has not been filed by the date specified above.
