E <br />LAKE MINNETONKA CONSERVATION DISTRICT <br />V <br />Study Report <br />Mora`:rium on Multiple Docks <br />4:00 pm, Tuesday, November 7, 1989 <br />LMCD Offices, Wayzrta depot <br />TO: Water Structures & Environment Committee <br />FROM: Chair Jim Grathwol <br />Present: Water Structures & Environment Committee Chair Jim Grathwol, Excelsior; <br />J.MCD Directors Doug Babcock, Spring Park; LMCD Chair Dave Cochran, <br />Greenwood; John Lewman, Minnetri.sta; Bob Rascop, Shorewood; Dave <br />Arndorfer and Frank Mixa, Cons:.lta.:ts; Gene Strommen, Executive Director <br />A review of an interim ordinance restricting the licensing, construction and <br />maintenance of new commercial and mulciole docks and new docks making common <br />use of adjacent dock -use -areas was :undertaken by persons in attendance at the <br />invitation of Grathwol. The inter'_m ordinance was prepared by attorney LeFevere <br />in response to the need to study zontrols which may be required as the density <br />of boats on Lake Minnetonka continues to grow according to the Management Study <br />underway b; Arndorfer Associates. <br />The int.erim ordinance was presented to the Water Structures & Environment Committ-se <br />at its October 14 meeting. Chair Cochran agreed that the ordinance will require <br />further study, and asked Grathwol, who was appointed chair of the Water Structures <br />& Environment Committee at tae October 25 Board meeting, to pursue further <br />study of this iriterim ordinance. <br />The study group meeting at this time reached a consensus for recommendation <br />to the Water :structures & Environment Committee consisting of the following: <br />1. An ordinancF change should be prepared to remove Type 3 and higher wetlands <br />from any cjn�:iderat.)n toward shoreline footage requirement applicable <br />to watercraft storage, provided a right -to -access is protected. (See attach- <br />ment for Wetland definition and types.) <br />2. Consider an ordin- which would prohibit docks which would create a condo- <br />minium dock over t ater. <br />3. The Water Structures & Environment Committee should consider amending the <br />proposed interim ordinance to accept land -zoned single family residential <br />which must meet the 1.50 requirements for watercraft wider the existing <br />ordinance, provided wetlands of Type 3 and hig;ier are not included i the <br />computation of the lakeshore. <br />4.
