CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono <br />City Council hereby grants a conditional use permit Section <br />10.24, Subdivision 3 (A) to permit the installation of the remote <br />switch building as proposed by Contel of Minnesota requiring the <br />approval of setback vmriances, north lot line proposed at 34' <br />instead of the required 501, and south lot line proposed at 46' <br />instead of the required 501, subject to the following conditions: <br />1. The remote switch building should be of earthy colors to <br />blend into the surrounding natural setting. <br />2. Applicant to provide landscaping along the west and <br />south sides of the utility building per landscape plans set <br />forth can site plan by Peter M. Brozik revised date November <br />7, 1989. <br />3. Owner of property is hereby advised to seek a s .karate <br />land use application with the City of Orono for any further <br />improvement of this property. <br />4. Authorities granted by this resolution run w.'' the <br />property not with the applicant, but are permissive c r and <br />must be exercised by application for a building permit for <br />the retaining walls within one year of the date of Council <br />approval, or the special conditions of this resolution will <br />expire on that date (November 13, 1990). <br />5. Violation of or non-compliance with any of the terms and <br />conditions of tnis resolution shall constitute a violation <br />of the zoning code, shall automatically terminate any <br />authority granted herein, and shall be punishable as a <br />misdemeanor. <br />b. The undersigned owner and applicant have read, <br />un'Qrstood and hereby agree to the terms of this resolution <br />and on behalf of themselves, their heirs, successors and <br />assigns, hereby agree to the recording of this resolution in <br />the chain of •:itle of the property. <br />Page 3 of 5 <br />
