Memo - Zoning File #1463 <br />October 11, 198' <br />Page Two of Three <br />structure is requited only from residential lot lines. <br />Brief Review of Application - <br />Contel proposes installation of a remote switch building <br />measuring 10 x 16 on a property owned by Fairview Covenant Church <br />located directly across County Road 19 within the City of <br />Minnetrista. The remote switch building meets the required <br />street setback of 35' but does not meet the required 50' setback <br />from the adjacent residential lot lines (i of er to the findings <br />noted above and Exhibit M). <br />Hardships have not been submitted with the application, but <br />applicant advised that because of the narrow width of the lot the <br />residential 50' setback could never be maintained from the north <br />and south lot line unless structure was moved to the rear of the <br />property. In addition, applicant notes that to move it to the <br />most mid position in the widest area of the property would <br />prevent the Church from expanding a parking lot to the east side <br />of the lot. If applicant moves structure to the south <br />maintaining the 35' setback, a setback variance would still be <br />required from the south lut line. Applicant should be prepared <br />to demonstrate why the relocation of the structure will have an <br />impact on future parking expansion to the east on the Church <br />property. <br />Please review Mr. McCurdy's letter. Applicant should be <br />prepared to respond as to feasibility of relocating <br />air conditioning units to either south or east side of structure. <br />In addition applicant should provide further information on <br />emission of sound emitting from the air conditioning units a:id <br />frequency of use of these cooling units. Is there a sound <br />barrier wall that could be considered outside of normal <br />plantings? <br />The lease agreemen} o various further improvements <br />of the property agreed t- icant in lieu of being allowed <br />to install the remote lding on property. Staff would <br />suggest that any furthe ,ruvements on the Church property are <br />subject to the Church filing a separate application with the City <br />for expansion of parking areas and other extra ciricular <br />facilities. It should also be noted that we cannot address <br />facilities used by the Church that are not on the Church <br />property, such as basketball hoop and outdoor grill. The Church <br />would be well advised to acquire the adjacent tax forfeit <br />property where intormal improvements have been installed. The <br />following con-iitions must be met if application is to be <br />approved: <br />
