The City Council finds thac granting a conditional -.3e <br />permit to allow the proposed grading and retaining walls in <br />the 0-75' zone will not be detrimental to the health, safety <br />or general welfare of the public, would not adversely affect <br />light, air nor pise a fire hazard or other danger to <br />neighboring properties, nor will it deprec ate surrounding <br />property values and that the proposed level of usa of the <br />property will be in keeping with the intent and objectives <br />of she Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono <br />City Coun,,il hereby grants variances to Municipal Zoning Code <br />Sections 10.22, Subdivisions 1 and 2 and 10.55, Subdivision 8 to <br />permit construction of a areenhcuse addition and retaining walls <br />in the 0-75' lakeshore setback ..one, resulting in an increase in <br />hardcover from 5.7% to 7.6% in 'he 0-75' zone where no hardcover <br />is normally allowed, resulting in additional Etruct•ire in the 0- <br />75' zone where no structure is normally allowed, resulting in an <br />average lakeshore setback encroachment of approximately 1251; and <br />further grants a conditional. use permit for grading and retaining <br />w�'.ls in the 0-75' lakeshore setback zone per Section 10.03, <br />Subdivision 19, subject to the following conditions: <br />1. Applicant shall <br />provide the <br />City Engineer with a <br />detailed <br />filial grading and <br />retaining <br />wall plan, which <br />must by <br />approved before <br />permits <br />can be issued <br />for the <br />grading/retaining <br />wail construction. <br />The City <br />Engineer <br />shall work in conjunction with <br />the applicants t- <br />Pstablich <br />suitable limits for <br />the grad' <br />work. <br />2. The applicants shall mair-ain existing vey-;t_ )n )n the <br />lakeshore bank as proposed, and shall plant addit onal <br />ve;3etation to screen the prop03,A 24"-30" high retaining <br />wall from r' lake to reduce its -isual impact. Applicant <br />shall :use r e materials and natural coloring �to minimize <br />the visual act of this wall to the greatest extent <br />possible. <br />3.
