Level of Support - <br />The ass.zmption on the Stubbs Bay project has been that the <br />Council would require a certain level of suppor-" as expressed in <br />waiver of assessment prior to undertaking the project. These <br />waivers of assessment initially would express the "top end" over <br />which any amount over that (apart from capitalized interest) <br />would require that new waivers be signed. Due to the nature of <br />the area, it is racommended that a certain percentage of the <br />property owners in the current area sign waivers prior to taking <br />further steps in the process. Not having a certain level of <br />assessment waiver, prior to the date that the pr-ject is ordered, <br />would place the City at risk for the special assessment portion <br />being appealed. (The staff is recommending a special assessment <br />level that would not be that much greater than t;ie Crvstal Bay <br />area finally was assessed), but this does not insure that this <br />would not be appealed or reduced.) <br />Issue 2 - Next Stubbs Bay Meeting <br />It woul- be appropriate that the meeting be held in <br />November/December in order for construction to be done next year. <br />In advance of that however, the City could communicate to the <br />residents that they would have to circulate among themselves a <br />petition and get a minimum percentage of persons interested in <br />undertaking the project. The City could request that the <br />assessment waivers be signed prior to the ur.lering of the <br />project. Once the petition is submitted, the CJnncil coul,1 have <br />a special meeting to address the questions raised and take any <br />additional qo�tions from the neighbors. <br />ALTERNATIVES - <br />Issue 1 - <br />1. Take a position of the Council on each of the <br />items. <br />2. Table for further discussion. <br />3. Take no acl.ion at this time. <br />Issue 2 - <br />1- Establish a meeting date. <br />2. Await Establishing a date until after a petition if <br />received. <br />3. Direct staff to send a letter regarding the level of <br />support needed. <br />
