As counsel for the City, however, we must naturally <br />address the City's interests in this matter. While I had hoped <br />that the suggestions contained in my letter to Attorney Mertz <br />of October 31 1989 would be an adequate solution to the problem <br />of obtaining consents from property owners interested in the <br />easement created in 1956, that proposal was unworkable given <br />the difficulty of obtaining the legal opinion requested therein <br />and the property owners' reluctance to defend the City's <br />easement in the event of a future challenge. <br />I further understand that the second proposal made by the <br />City as an alternative to the suggestions identified in my <br />October <br />torne 3Mertz)letter <br />are`alsooutlined <br />unacceptable ttoOctober <br />your clientletter to <br />Att.
