City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />NUNICIYAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 & 2 AND <br />SECTION 10.55, SUBDIVISION 8 <br />FILE #1452 <br />WHEREAS, Marilyn & Walter Pemberton (hereinafter "the <br />applicants") are owners of the property located at 1720 Shadywood <br />Road within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />Lots 12 & 13, except that part of said Lot 12 lying <br />northerly of a line drawn parallel with and distant 71.2' <br />northerly measured at right angles from the southerly line <br />of said Lot 13, Shadywood Road, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for <br />variances to Municipal Zoning Code Section 10.22, Subdivisions 1 <br />& 2 and Section 10.55, Subdivision 8 to permit the construction <br />of a room addition to the existing residence, which addition is <br />entirely located within the 0-75' lakeshore setback zone where no <br />structure or hardcover is n,rmalll allowed. <br />NOW, THEREFORE, BE IT RESOLV'.3D by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1452. <br />2. The property is located in the LR-lC Single Family <br />Lakeshore Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on September 18, 1989, and recommended conditional approval <br />of the proposed variances based upon the following findings: <br />A) Existing hardcover in the 0-75' zone is 26.78%. <br />Existing hardcover in the 75-250' zone is 58.04%. <br />These hardcover amounts are unusually excessive for the <br />LR-lC district and any proposed structural additions on <br />the property should be subject to a concurrent <br />reduction in overall hardcover on the property. <br />Page 1 of 5 <br />
