City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2717 <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 <br />FILE #1441 <br />WHEREAS. Donald W. Copley (hereinafter "the applicant") <br />is the owner of the property located at 1185 Tonkawa Road within <br />the City of Orono (hereinafter "City") irt3 legally described as <br />Tract B, Registered Land Survey #853, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.22, Subdivision 1 to <br />allow constructio_• of an addition to the existing residence <br />located 1-1h' in front of the average lakeshore setback line and <br />a variance to Section 10.22, Subdivision 2 seeking approval of a <br />hardcover variance within the 75-250' setback area of 290.3 <br />square feet or 1.2% over the allowed hardcover of 5,707 square <br />feet or 25%. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This applicat'on was reviewed as Zoning File #1441. <br />2. The property is located in the LR-1B Single Family <br />Lakeshore Residential Zoning District requiring 1 acre in <br />area. The property consists of 28,405 square feet or .65 <br />acres. <br />3. The Crono Planning Commission reviewed this application <br />on September 6 1989 and September 18, 1989, and recommended <br />approval of the average setback variance application and <br />recommended no hardcover be added over the 25% limit, based <br />upon the following findings: <br />A) The encroachment of the average lakeshore setback <br />is minimal at 1-1h' and will i,ave no negative impact on <br />the lake views of the adjacent rt-idences. <br />B) There is no hardcover in the 0 5' setback area on <br />the property. <br />Page 1 of 4 <br />
