� y <br /> i - L . . 1 <br /> • � RESOLUTION N0. /O� ' . <br /> A RESOLUTION APPROVING A CONDITIONAL <br /> USE PERMIT AND HARDCOVER VARIANCE <br /> FOR RONALD CHRISTENSEN � • <br /> WHEREAS, the Planning Commission and City Council have 4 <br /> reviewed a reguest by Ronald Christensen to reconstruct and relocate <br /> an attached garage at his residence located at 3587 North Shore Drive; <br /> and <br /> ' WHEREAS, said proposal entails major alteration of the lot <br /> by grading, filling and retaining wall construction all within 75 ft. <br /> of Lake Minnetonka, which work requires conditional use approval <br /> pursuant to Section 31. 700 of the Orono Municipal Code; and <br /> WHEREAS, said proposal entails construction of a building <br /> and driveway within 75 ft. of Lake �Minnetonka which work requires <br /> a variance to Section 34. 202 of the Orono Municipal Code; - <br /> \ <br /> . NOW, THEREFORE, BE IT RESOLVED, that based upon Planning � <br /> Commission and City staff research, the City Council hereby makes <br /> the following findings of fact: <br /> • l. There is an existing residence, an existing detached <br /> garage and existing driveway surface on the subject lot, <br /> all located within 75 ft. of Lake Minnetonka <br /> 2. There is too much existing hardcover on the lot and <br /> , no adequate drainage, erosion or siltation control system. <br /> 3. There is an existingrflooding problem of the residence <br /> and the garage caused by runoff �coming from County Road 15 <br /> down onto the property, which flooding threatens the use • <br /> and structural integrity of the existing buildings. <br /> 4. The existing drainage patterns cause excessive erosion <br /> and flow directly into Lake Minnetonka. <br /> 5. The existing driveway onto the property is steep and <br /> ices dangerously in the winter months. t <br /> 6. The existing private road serving this property and <br /> five others has an inadequate intersection with County � <br /> Road 51 with limited maneuvering room or sight lines. <br /> ' 7. The proposal would raise the garage floor and eliminate <br /> flooding or flood damage to the home. <br /> . 8. The proposal would regrade and raise the driveway <br /> elevation to redirect drainage away from Lake Minnetonka, <br /> reducing erosion and direct siltation. , <br />
