C) applicant's past use of the existing guest house <br />has been to occasionally allow zelatives, friends or <br />acquaintances to live there as a security measure while <br />applicant is out of the state. <br />D) Applicant ncfQs that his future intent would be to <br />never use the dwelling unit as anything other than a <br />guest house and he has no inter' to use it as a rental <br />apartment. <br />E) Municipal Zoning Code Section 10.20, Subdivision 3 <br />(G) requires that a guest house meet all regulai lot <br />requirements. The existing guest house unit is located <br />10' from the principal residence, hence the 20' setback <br />required in order to potentially place the guest house <br />on a separate conforming lot, would be impossible to <br />obtain. Further, the existing lot area is 0.81 acres <br />in this 0.5 acre zone. Appli ;ant has been unable to <br />purchase a .17 acre parcel te-, his west to increase his <br />property size nearer to the required 1.0 acres in order <br />to meet the guest house lot area requirem nt. <br />F) The existing guest house unit is more than 50' from <br />all property boundaries, hence continued use of the <br />unit as a guest house would have no sia_� icant visual <br />impact on the neighb.jrhood. <br />4. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by City staff, comments by the applicant <br />and the effect of the proposed use on the health, safety and <br />welfare of the community. <br />5. The City Council finds that granting a conditional use <br />permit to allow continued use of the existing detached <br />dwelling unit above the garage as a guest house will riot be <br />detrimental to the health, safety or welfare of the general <br />public; would nu' adversely affect light, air nor pose a <br />fire hazard or otliu- danger to neighboring properties; nor <br />would it depreciate surrounding property values. The <br />Council further finds that the proposed level of use on the <br />property will be in keeping with the intent and obje.tives <br />of the Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 5 <br />
