CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above fin,'?ngs, the Orono City <br />Council hereby grants a conditional use permit per Municipal Zoning Code <br />Section 10.2J, Subdivision 3 (D) to permit the construction of a pumping <br />station/life station on the property, and per Section 10.20, Subdivision 3 <br />'D) grants a setback variance from the east lot line of 40' or 80% and a <br />.etback variance from the north lot line of 25' or 50% where a 50' setback <br />is required from all adjacent residential zoned properties, and per Section <br />10.25, �-,ubdivision 6 (B) grants a street setback variance of 25' or 831 <br />where 30' is required for all structures and a rear setbacx variance of 5' <br />or 17% where a 30' setback is required from the rear lot line, subject to <br />the following conditions: <br />1. Approval of a structure with a pitched roof with brick facia not <br />to exceed 201x32' per plans by Bonetroo, Rosene, Anderlick & <br />Associates entitled "Orono Interceptor Improvements - Lift Station 44" <br />dated October 19, 1988, conn. 0612. <br />2. All access to the site must rP vs the private driveway along the <br />west side lot line, no direct access onto County road will be allowed. <br />3. Any proposed changes in use of this structure or a major <br />intensification in use must be approved by the City of Orono. <br />4. Authorities granted by this resolution run with the property not <br />with the applicant, but are permissive only and must be exercised by <br />application for a building permit within one year of the date of <br />Council approval, or the special conditions of this resolution will <br />expire on that date (September [5, 1990). <br />5. Violation of or non-compliance with any of the terms an(' condi- <br />tions of this re volution shall constitute a violation of the zoning <br />code, shall automatically terminate any authority granted herein, and <br />shall be punishable as a misdemeanor.. <br />6. The undersigned applicant has reaO, understood and hereby agrees <br />to the terms of this resolution and on behalf of the Metropolitan <br />Waste Control Commission its successors and assigns hereby agrees to <br />th(. recording of this resolution in the chain of title of the <br />property. <br />Page 3 of 5 <br />
