To require the structure to <br />be moved to meet required 10' structure -to -structure setback <br />would not seem to be reasonable, although that is one of the City <br />Council's options. <br />Perhaps a more realistic option would be to grant the after - <br />the -fact variance conditioned on an inspection being made to <br />verify that the appropriate fire wall exists in both the attached <br />and detached garages, so that the fire code separation <br />requirements will be met. Note that the applicants have paid the <br />after -the -fact variance double fee as a penalty. <br />Planning Commission is requested to review the letters <br />submitted by the applicants and by Mr. & Mrs. Childs who are in <br />the process of purchasing this property from the Emfields. <br />Staff Reco®endation - <br />Given the unusual circumstances of this application, staff <br />would recommend approval of an after -the -fact structure -to - <br />structure setback variance to allow the existing detached garage <br />to remain in its current location, subject to the following <br />conditions: <br />1. Applicants shall obtain a building permit and shall make <br />the necessary modifications to the garage to meet minimum <br />fire separation standards (sheet rock interior walls at <br />affected garage corners). <br />2. Current and future homeowners are advised that the <br />detached garage and attached garage must remain structurally <br />detached from each other. Any future request to attach the <br />two structures will first require obtaining a side setback <br />variance to the 30' mininum side setback standard per the <br />RR-lB zone. <br />
