City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />CITY O. <br />OF <br />ORONO <br />8. The City Council finds t.i. ditions existing on this <br />property are peculiar :.ai .apply generally to other <br />property in this zoning dib nat granting the variance <br />would not adversely affect t_ anditions, light, air nor <br />pose a fire hazard or other dar._ . to neighboring property; <br />would not merely serve as a convenience to the applicant, but <br />is necessary to alleviate a demonstrable hardship or <br />difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit <br />and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Ba:.ed upon the above findings, the Gronc :.ity Council her. -,by <br />grants a -affiance to the Municipal Zoning Code Section 10.2., <br />Subdivisi�_ and Section 10.55, Subdivision 8, to allow the <br />construction of a new home located partially within the 0-75' <br />lakeshore setback area where no structures are normally allowed, and <br />grants a variance to Section 10.22, Subdivib:on 2 to allow a total of <br />2,960 square feet of hardcover (or 15.8%) in thv 0-75' setback zone at <br />the building site wh^re no hardcover is allowec', and to allow 3,380 <br />square ;*et of hardc., per (or 301 } in the 75-250 keshore setback zone <br />at the u .;lding site, where only 25% hardcover .,)rmal-, allowed, jond <br />grants a variance to Section 10.22, Subo.rision 1, to -il'-w <br />encr,achment on the average lakeshore setbac:. :rom the lago�,r. (fir <br />north)side of the building site, subject to the following conditions: <br />1. All drainage from the proposed hou- must be directed towasd <br />the lagoon to gain the maximum ►• ?-.:.ble infiltration time <br />and distance. <br />2. A site grading plan mu.
