1. The retaining wall shall be built prior to any <br />landscaping work within the wall, so that wall can act as <br />protective zone from erosion or damage to the exterior banks <br />along the lake. <br />2. Material banked against the outside of the wall should be <br />of a cohesive nature and stabilization fabric should be used <br />within the backfill to prevent erosion. Silt fence will be <br />required at the base of the filled areas where slope is <br />steeper than 4:1. <br />3. Wall sections cannot exceed the 956' elevation nor shall <br />6' of vertical wall be exposed. <br />4. Applicant's contractor/consultant is to arrange for a <br />pre -construction meeting with the Orono staff so that an <br />appropriate schedule of inspections can be arranged during <br />the installation of the retaining wall and drainage system. <br />5. Upon application of a building permit for the retaining <br />walls, applicant's consultant must submit detailed plan on <br />planters and the wall tied back system. <br />6. Authorities granted by this resolution run with the <br />property not with the applicant, but are permissive only and <br />must be exercised by application for a building permit for <br />the retaining walls within one year of the date of Council <br />approval, or the special conditions of this resolution will <br />expire on that date (September 25, 1990). <br />7. Violation of or non-compliance with any of the terms and <br />conditions of this resolution shall constitute a violation <br />of the zoning code, shall automatically terminate any <br />authority granted herein, and shall be punishable as a <br />misdemeanor. <br />B. The undersigned applicant has read, understood and <br />hereby agrees to the terms of this resolution and on behalf <br />of himself, his heirs, successors and assigns, hereby agrees <br />to the recording of this resolution in the chain of title of <br />the property. <br />Page 3 of 5 <br />
