UNUSUAL PROPERTY CONDITIONS: The original placement of house <br />on the lot is unusual. The house is very well screened from <br />Fox Street on the south by dense shrubbery and trees. It is <br />visible driving east on Fox Street, but presents a pleasing <br />appearance from that view. Location of pool house southeasterly <br />of pool and terrace would not be noticeable and/or obtrusive. <br />REQUEST FOR INTERPRETATION: Private drive west of lot is well <br />developed, prominent. If area to west and north of this lot <br />is developed, this private drive would be a logical, dedicated <br />private (or public) access. It now proceeds out to Brown Road <br />as well. This should be sufficient reason to determine that <br />this lc- is a corner lot, permitting a choice of front yards <br />to the owner. The previous owner has obviously already chosen <br />the west lot line as his front line. It is the lin-, from which <br />the access comes. If that interpretation is made, the swimming <br />pool reconstruction and the pool house construction would be <br />to the side of the house, not n front of it, would not conflict <br />with Section 10.03, Subdivision 9(D) of the Zoning Code, and <br />would still remain more than 80 feet back from Fox Street, <br />well within a front yard set back there. <br />If variance from 50 foot required front yard set back from <br />west line is required due to deck, terrace and new pool house, <br />it should be readily granted on grounds the City originally <br />granted building permit which contemplated a 30 foot set back <br />from that west line of the terrace and deck improvements. <br />The following attachments are made a part of this Application: <br />1.
