c) The special conditions applying to the <br />structure or land in question are not peculiar to <br />this property but are typical of many properties <br />in the area. <br />d) The granting of the application is not <br />necessary for the preservation and enjoyment of a <br />substantial property right of the applicant. <br />e) The granting of the variance will merely serve <br />as a convenience to the applicant, but no hardship <br />has been demonstrated which justifies granting of <br />the after -the -fact variance. <br />The City Council finds that regarding the retaining <br />wills, the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this <br />zon=ng district; that granting the variance to allow <br />construction of retaining walls would not adversely affect <br />traffic conditions, light, air nor pose a fire hazard or <br />other danger to neighboring properties, would not merely <br />serve as a convenience to the applicant but is necessary to <br />alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve the stability of the lakeshore bank; <br />is necessary to preserve a substantial property right_ of the <br />applicant; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />5. The City Council finds that granting a conditional use <br />permit to allow the construction of the proposed retaining <br />walls will not be detrimental to the health, safety or <br />general welfare of the public, would not adversely affect <br />light, air nor pose a fire hazard or other danager to <br />neighboring properties, would not merely serve as a <br />convenience to the applicant but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to <br />preserve the stability of the lakeshore bank; is necessary <br />to preserve a substantial property right of thA applicant; <br />and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />Page 3 of 6 <br />
