§ 1.08,210 <br />ORONO CODE <br />(3) They may, based on such facts, declare a <br />state of emergency. <br />(4) By majority vote of those persons pres- <br />ent, regardless of number, they shall fill <br />all positions on the council, including the <br />office of mayor, of those persons upon <br />whom notice could not be served or who <br />are unable to be present. <br />(5) Such interim successors shall serve until <br />such time as the duly elected official is <br />again available and returns to that posi- <br />tion, or the state of emergency has passed <br />and a successor is designated and quali- <br />fies as required by law, whichever shall <br />occur first. <br />(c) Duties of the interim emergency council. <br />The interim emergency council shall exercise the <br />powers and duties of their offices and appoint <br />other key government officials to serve during <br />the emergency. <br />(Code 1984, § 2.10; Code 2003, § 2-71) <br />Sec. 1.08.220. Workers' compensation. <br />All officers of the city elected or appointed for <br />a regular term of office or to complete the <br />unexpired portion of any such regular term shall <br />be included in the definition of employee as that <br />term is defined in state law relating to coverage <br />for purposes of workers' compensation entitle- <br />ment. The term "employee" shall include, but <br />not by way of limitation, police reserve officers. <br />(Code 1984, § 2.16; Code 2003, § 2-72) <br />State law reference —Authority to expand workers' <br />compensation coverage to persons elected or appointed for <br />regular term of office, Minn. Stats. § 176.011, subd. 9(6). <br />Sec. 1.08.230. Computerized criminal his- <br />tory and driver's license his- <br />tory inquiries. <br />(a) Purpose. The purpose of this section is to <br />authorize the city to conduct computerized <br />criminal history (CCH) and driver's license his- <br />tory inquiries on persons who are finalists for <br />certain employment positions in the city and <br />who are volunteers in city programs providing <br />services to children or vulnerable adults. Access <br />for these purposes shall be limited to state CCH <br />public data only. Nothing in this section shall be <br />construed to preclude the city from conducting <br />comprehensive background investigations of <br />applicants for city employment positions, includ- <br />ing, but not limited to, accessing public data <br />through other automated and non -automated <br />sources and contacting references. Nothing in <br />this section shall be construed to preclude the <br />city from periodically conducting a driver's license <br />inquiry upon employees or volunteers where <br />possession of a valid driver's license is an essential <br />qualification of the position. <br />(b) Definitions. The following words, terms <br />and phrases, when used in this section, shall <br />have the meanings ascribed to them in this <br />subsection, except where the context clearly <br />indicates a different meaning: <br />Computerized criminal history inquiries means <br />criminal histories obtained through the state <br />bureau of criminal apprehension's computerized <br />criminal history system. <br />Driver's license history inquiries means driver's <br />license violations recorded by the state depart- <br />ment of public safety. <br />(c) Findings of the city council. The city council <br />makes the following findings regarding the need <br />to conduct computerized criminal history and <br />driver's license history inquiries on persons who <br />are finalists for certain city positions and who <br />are applying to volunteer in city programs provid- <br />ing services to children or vulnerable adults, <br />recognizing that the city council has a significant <br />interest in protecting the general public in the <br />performance of government services: <br />(1) Certain city employees and volunteers <br />work independently with and provide <br />public services to some of the most vulner- <br />able members of society: children, senior <br />citizens, developmentally disabled <br />individuals, and mentally ill persons. <br />Protection of these vulnerable persons <br />warrants the investigation of persons <br />who are finalists to fill these certain <br />employment positions with the city and <br />who are applying to volunteer in city <br />programs that provide services to these <br />members of the public. <br />CD1:12 <br />
