Handling, use of weapons by <br />children. <br />No person shall permit, as a parent or guard- <br />ian, any child under 14 years of age to handle or <br />use, outside of the parent's or guardian's pres- <br />ence, a firearm or air gun of any kind, or any <br />ammunition or explosive. <br />(Code 1984, § 9.10(1)(G); Code 2003, § 70-104) <br />State law reference —Similar provisions, Minn. Stats. <br />§ 609.66, subd. 1(a)(6). <br />Sec. 5.36.400. BB gun. <br />The use of a BB gun or air rifle is subject to <br />the following circumstances: <br />(1) There is a demonstrated nuisance of an <br />animal to the property owner. <br />(2) The permittee has the property owner's <br />permission. <br />(3) There are no other appropriate means <br />available. <br />(4) Seasonal restrictions of game animals <br />apply. <br />(5) The gun may only be discharged in a <br />manner that does not direct it towards <br />other buildings or persons. <br />(6) The permittee must notify all abutting <br />owners. <br />(Code 1984, § 9.10(5); Code 2003, § 70-105) <br />Subdivision II. Permits <br />Sec. 5.36.510. Occasional up to 15 days. <br />Occasional permits valid for a period of 15 <br />days or less may be granted to clubs or persons <br />as follows: <br />(1) Occasional target shooting or trap and <br />skeet shooting. <br />(2) Field trials, commercial or professional <br />exhibitions or displays, or other similar <br />lawful purpose as determined by the <br />police. <br />(3) For training of dogs for clubs or individu- <br />als, which permit is valid only on land <br />§ 5.36.520 <br />described in the permit by persons with <br />the consent of the owner or lessee of the <br />land. <br />(Code 1984, § 9.10(4)(A); Code 2003, § 70-121) <br />Sec. 5.36.520. Occasional up to 120 days. <br />(a) For control of pests in commercial or <br />agricultural situations, permits may be granted <br />up to a maximum of 120 days as established by <br />the city administrator to persons or clubs meet- <br />ing all the following criteria: <br />(1) For control of pests, vermin, rodents or <br />other animal nuisances, such as deer <br />hunting by bow and arrow during <br />appropriate season, or other animals that <br />are a demonstrated nuisance. <br />(2) Where there are no other appropriate <br />methods available. <br />(3) Demonstrated need for a longer duration <br />of time, such as length of game season or <br />protection of crops during the growing <br />season. <br />(b) The use of bow and arrow under this <br />section will be allowed on an occasional basis to <br />remove problematic animals, including game <br />animals, subject to the following circumstances: <br />(1) There is a demonstrated nuisance of that <br />animal to the property owner. <br />(2) The property owner has specifically given <br />written permission to a hunter, and that <br />hunter has the appropriate state hunting <br />permit. <br />(3) That no discharging is to be done within <br />100 feet of any property line, within 100 <br />feet of any buildings and within 200 feet <br />of any livestock. <br />(4) Discharge for purposes of this section <br />shall only be done from an elevated stand <br />that is a minimum of four feet off the <br />ground. <br />(5) Can only be done during the appropriate <br />season. <br />CD5:75 <br />
