Unreasonable acceleration. <br />No person shall unreasonably and/or unneces- <br />sarily accelerate a motor vehicle so rapidly and <br />abruptly that a tire or tires break traction with <br />the street surface, causing a squealing sound or <br />dislodging sand, gravel or other objects by the <br />tires. The unreasonable or unnecessary accelera- <br />tion is prohibited on any public street or highway <br />or any private property within the city. <br />(Code 2003, § 66-258; Ord. Unsafe operation. <br />No person shall drive or operate a motor <br />vehicle, motorized bicycle or motorized foot scooter <br />on any street, highway, road, roadway or private <br />property in a manner which is unsafe. The term <br />"unsafe" means, but is not limited to, distracted <br />driving, speeds and/or maneuvers which are not <br />reasonable or prudent or safe given the weather, <br />road conditions, vehicle conditions, the proxim- <br />ity of persons and other vehicles and includes <br />such driving or operation which is unsafe for the <br />driver or operator. <br />(Code 2003, § 66-259; Ord. Violation of state statutes <br />prohibited. <br />It is unlawful to violate any state statute. <br />(Code 2003, § 70-1) <br />Sec. 5.36.020. Swimming restricted. <br />§ 5.36.040 <br />No person shall voluntarily enter the waters <br />of any river or public swimming pool at any time <br />when such waters are not properly supervised by <br />trained lifesaving personnel in attendance for <br />that purpose, or enter such waters without being <br />garbed in a bathing suit sufficient to cover his <br />person and equal to the standards generally <br />adopted and accepted by the public. <br />(Code 1984, § 9.20(5); Code 2003, § 70-2) <br />State law references —Indecent exposure, Minn. Depositing refuse restricted. <br />No person shall strew, scatter, litter, throw, <br />dispose of or deposit any refuse, garbage or <br />rubbish unto any premises except into receptacles <br />provided for such purpose. <br />(Code 1984, § 9.20(11); Code 2003, § 70-3) <br />State law reference —Littering, Minn. Public nuisance. <br />(a) It is unlawful for any person to maintain a <br />public nuisance by his act or failure to perform a <br />legal duty. For purposes of this section, a public <br />nuisance shall be defined as any of the following: <br />(1) Maintaining or permitting a condition <br />which unreasonably annoys, injures or <br />endangers the safety, health, morals, <br />comfort or repose of any considerable <br />number of members of the public; <br />(2) Interfering with, obstructing or render- <br />ing dangerous for passage any street, <br />public right-of-way or waters used by the <br />public; or <br />(3) Any other act or omission declared by <br />law to be a public nuisance. <br />(b) It is unlawful for any person to permit real <br />property under his control to be used to maintain <br />a public nuisance, or let the property to another <br />knowing it is to be so used. <br />(Code 1984, §§ 9.21, 9.22; Code 2003, § 70-4; Ord. <br />No. 108(2nd series), § 1, 8-24-1992) <br />State law references —Public nuisance prohibited, Minn. <br />Stats. § 609.74; authority to prohibit nuisances, Minn.
