M <br />ti <br />N <br />§ 5.28.430 <br />Sec. 5.28.430. Warning of vicious dogs. <br />ORONO CODE <br />The owner of any dog known to be of vicious <br />habits shall place in plain view of the entrance of <br />the premises a sign no smaller than 12 inches by <br />14 inches which shall read "Beware of Vicious <br />Dog" in letters at least two inches in height. <br />(Code 2003, § 62-103; Ord. No. 137(2nd series), <br />§ 9.12(13), 7-24-1995) <br />Sec. 5.28.440. Running at large prohibited. <br />It is unlawful for the owner of any dog to <br />permit such animal to run at large. Any dog <br />shall be deemed to be running at large with the <br />permission of the owner unless: <br />(1) It is on a durable leash secured to an <br />object which it cannot move and is on the <br />premises of the owner. <br />(2) On a leash and under the control or <br />within ten feet and under the effective <br />command of the accompanying person of <br />suitable age and discretion. <br />(3) In the owners' fenced yard or other suit- <br />able enclosure where the dog cannot <br />leave without human assistance. <br />(4) In the owner's yard and under effective <br />command of an accompanying person of <br />suitable age and discretion present outside <br />in the yard. <br />(5) In a vehicle from which the dog cannot <br />leave without human assistance, provided <br />it is not left unattended in violation of <br />law. <br />(6) In an area designated as an off leash <br />area, provided that the person having <br />custody of the animal is present with the <br />animal, has in his/her possession the <br />required off leash permit, and is acting in <br />compliance with the rules and regula- <br />tions of the off leash areas. <br />(Code 2003, § 62-104; Ord. Defecating on property of <br />another prohibited. <br />It is unlawful for the owner of any dog to fail <br />to prevent such dog from defecating in or upon <br />public property or the premises of another, or to <br />permit solid waste of a dog to accumulate on its <br />owner's premises for more than 24 hours. <br />(Code 2003, § 62-105; Ord. No. 137(2nd series), <br />§ 9.12(11(4)), (11(5)), 7-24-1995) <br />Division 2. Kennels* <br />Subdivision I. In General <br />Sec. 5.28.610. Definitions. <br />The following words, terms and phrases, when <br />used in this division, shall have the meanings <br />ascribed to them in this section, except where <br />the context clearly indicates a different meaning: <br />Commercial kennel means any place or <br />premises where three or more dogs over six <br />months of age are kept or housed at any one time <br />for commercial purposes, including sale, board- <br />ing, breeding, grooming, training or medical <br />care. <br />Kennel structure means a dog house or <br />enclosure of any kind, including a fenced pen or <br />dog run, constructed, maintained or used for <br />purposes of keeping, housing or restraining one <br />or more dogs in a limited area. A fenced -in yard <br />area amounting to 600 square feet or more per <br />dog shall not be defined as a kennel structure. <br />Residential kennel means an accessory <br />residential use or place where three or more dogs <br />or five or more cats over six months of age are <br />kept or housed for the sole noncommercial use, <br />benefit or enjoyment of the property owner or <br />occupant. <br />(Code 1984, § 5.36(1); Code 2003, § 62-161; Ord. <br />No. 208(2nd series), § 1, 10-22-2001) <br />Subdivision II. License <br />Sec. 5.28.710. Required. <br />(a) It is unlawful for any person to own, <br />operate, use, maintain or allow to exist any <br />kennel on any property without a license from <br />the city in accordance with this subdivision. <br />*State law reference Kennel licenses, Minn.
