W <br />c.0 <br />N <br />PUBLIC PROTECTION <br />commenced during nonbusiness hours of the city, <br />at the beginning of business hours of the first <br />day thereafter. Any person responsible for such <br />emergency work shall take all reasonable actions <br />to minimize the amount of noise and its dura- <br />tion. <br />(b) Emergency vehicle sirens and civil defense <br />systems. Sound produced by machines or devices <br />for the production of sound on or in emergency <br />vehicles and warning signals or systems for civil <br />defense and public safety are exempt from this <br />article. <br />(Code 2003, § 58-122; Ord. No. 155(2nd series), <br />§ 8(9.24(5)), 2-10-1997) <br />ARTICLE IV. OPEN BURNING* <br />Division 1. Generally <br />Sec. 5.24.1110. Definitions. <br />The following words, terms and phrases, when <br />used in this article, shall have the meanings <br />ascribed to them in this section, except where <br />the context clearly indicates a different meaning: <br />Fire department training fires means a fire <br />used for the purpose of fire department training <br />under the conditions of a permit from the state <br />pollution control agency. <br />Large brush disposal fire means a fire set with <br />approved starter fuel no more than 15 feet in <br />diameter and six feet in height using any clean <br />dry wood, producing minimal smoke, odor or soot <br />beyond the property line; conducted with an <br />adult tending the fire site at all times; <br />extinguished completely before leaving the site; <br />and respecting weather conditions, neighbors, <br />burning bans, and air quality so that nuisance, <br />health or safety hazards will not be created. A <br />minimum lot size of five acres is required for <br />large brush disposal fires. Large brush disposal <br />fire sites shall not be located closer than 150 feet <br />to any structure or 75 feet from any lot line. An <br />adequate water supply for fire suppression <br />purposes must be provided. Only materials gener- <br />*State law reference —Open burning, Minn. Burning of <br />materials brought onto the property from other <br />sites is prohibited. <br />Native prairie restoration fires means fires <br />used for the purposes of native prairie <br />maintenance conducted under the supervision of <br />qualified individuals or firms specializing in this <br />type of work. <br />Open burning means the burning of any matter <br />if the resultant combustion products are emitted <br />directly to the atmosphere without passing <br />through a stack, duct or chimney. The term <br />"open burning" includes brush disposal fires of <br />any size, fires for fire department training <br />purposes, and fires for maintenance of native <br />prairie areas. <br />Recreational fire means a fire set with approved <br />starter fuel no more than three feet in height <br />and diameter, using dry, clean wood; producing <br />little detectable smoke, odor or soot beyond the <br />property line; conducted with an adult tending <br />the fire at all times; for recreational, ceremonial, <br />food preparation or social purposes; extinguished <br />completely before quitting the occasion; and <br />respecting weather conditions, neighbors, burn- <br />ing bans, and air quality so that nuisance, health <br />or safety hazards will not be created. Approved <br />mobile cooking devices such as manufactured <br />hibachis, charcoal grills, wood smokers and <br />propane or natural gas devices are not defined as <br />recreational fires. Recreational fires are allowed <br />on any size lot, provided that all other permit <br />conditions can be met. Recreational fire sites <br />shall not be located closer than 50 feet to any <br />structure or 25 feet from any lot line. An adequate <br />water supply for fire suppression purposes must <br />be provided. <br />Small brush disposal fire means a fire set <br />with approved starter fuel no more than eight <br />feet in diameter and four feet in height using any <br />clean dry wood, producing minimal smoke, odor <br />or soot beyond the property line; conducted with <br />an adult tending the fire site at all times; <br />extinguished completely before leaving the site; <br />and respecting weather conditions, neighbors, <br />burning bans, and air quality so that nuisance, <br />health or safety hazards will not be created. A <br />minimum lot size of two acres is required for <br />CD5:47 <br />
