Collection for activities <br />undertaken by health <br />authority. <br />The city council shall from time to time <br />establish fees for activities undertaken by the <br />health authority pursuant to this article. Fees <br />shall be due and payable at a time and in a <br />manner to be determined by the health author- <br />ity. <br />(Code 2003, § 58-77; Ord. Invalidity; continued <br />enforcement. <br />If a provision or application of this article is <br />held invalid, that invalidity shall not affect the <br />validity of other provisions or applications of this <br />article. <br />(Code 2003, § 58-78; Ord. No. 212(3rd series), <br />§ 1, 8-13-2018) <br />ARTICLE III. NOISE* <br />Sec. 5.24.1010. Definitions. <br />Words or phrases used in this article and <br />defined in the rules of the Minnesota Pollution <br />Control Agency Noise Pollution Control, chapter <br />7030, shall have the meanings given in those <br />rules. The following words, terms and phrases, <br />when used in this article, shall have the mean- <br />ings ascribed to them in this section, except <br />where the context clearly indicates a different <br />meaning: <br />Cutout and bypass mean a mechanism which <br />varies the exhaust system gas flow so as to <br />*State law reference —Authority relative to noise, Minn. <br />Stats. §§ 116.07, subd. 2, 412.221, subd. 24. <br />§ 5.24.1010 <br />discharge the exhaust gas and acoustic energy to <br />the atmosphere without passing through the <br />entire length of the system, including all exhaust <br />system sound attenuation components. <br />dB(A) means a unit of sound level expressed <br />in decibels W13) and A -weighted. <br />Excessive noise means the presence of any <br />noise or combination of noises in such quantity, <br />at such levels, or such nature and duration or <br />under such conditions as could potentially be <br />injurious to human health, safety or welfare or <br />to animal life, or could interfere unreasonably <br />with the enjoyment of life or property. <br />Exhaust system means a combination of <br />components which provides an enclosed flow of <br />exhaust gas from engine parts to the atmosphere. <br />Holiday means any day fixed by the United <br />States or by state law for suspension of business <br />in whole or in part. <br />MPCA means the Minnesota Pollution Control <br />Agency. <br />Municipality means the city. <br />Noise means any sound not occurring in the <br />natural environment, including, but not limited <br />to, sounds emanating from airways, roadways, <br />waterways and industrial, commercial and <br />residential sources. <br />Noise control officer means any of the city <br />employees authorized to issue citations as listed <br />in section 1.08.020. <br />Person means any individual, firm, partner- <br />ship, corporation, trustee, association, the state <br />and its agencies and subdivision, or any body of <br />persons whether incorporated or not. With respect <br />to acts prohibited or required in this article, the <br />term "person" includes employees and licensees. <br />Weighted and A -weighted mean a specific weigh- <br />ing of the sound pressure level for the purpose of <br />determining the human response to sound. The <br />specific weighing characteristics and tolerances <br />are those given in American National Standards <br />Institute 1.4-1983, section 5.1. <br />(Code 2003, § 58-116; Ord.
