FIRE PREVENTION AND <br />PROTECTION* <br />ARTICLE I. IN GENERAL (RESERVED) <br />ARTICLE II. FIRE PREVENTION AND FIRE <br />SAFETY STANDARDSt <br />Division 1. Generally <br />Sec. 5.08.110. Definitions. <br />The following words, terms and phrases, when <br />used in this article, the fire code or the fire <br />marshal division alterations and amendments, <br />shall have the meanings ascribed to them in this <br />section, except where the context clearly indicates <br />a different meaning: <br />Building official means the person appointed <br />by the council to administer and enforce the <br />state building code. <br />Corporation counsel means the attorney for <br />the city. <br />Fire chief means the chief of the city fire <br />department or his authorized representative. <br />Fire marshal means the person appointed by <br />the council to administer and enforce the state <br />fire code and who operates under the direction of <br />the fire chief. <br />Jurisdiction and municipality mean the city <br />as a whole, and also that part of the city <br />corresponding to each separate fire service district. <br />(Code 1984, § 9.34(3); Code 2003, § 46-31; Ord. <br />No. 287(3rd series), § 1, 12-11-2023) <br />*State law reference —General authority relative to fire <br />prevention, Minn. Enforcement. <br />Authority for enforcement of this article is <br />granted to and may be exercised by the state fire <br />marshal or the fire chief or the chiefs representa- <br />tives. The fire chief may detail such members of <br />the fire department as may be necessary to <br />administer and enforce the provisions of this <br />chapter. <br />(Code 1984, § 9.34(4); Code 2003, § 46-32; Ord. <br />No. 287(3rd series), § 2, 12-11-2023) <br />Sec. 5.08.130. Permits and fees. <br />(a) Wherever the fire code or this article <br />requires a permit, applications for such permit <br />shall be made to the building official with all <br />information required, and payment of a permit <br />application fee as fixed and determined by resolu- <br />tion. Application fees shall be nonrefundable. <br />(b) The building official shall refer all fire <br />code permit applications to the fire chief, who <br />shall perform required pre -permit inspections. <br />The fire chief shall, upon request by the building <br />official, supply a written report to the building <br />official prior to permit issuance. <br />(c) All fire code permits shall be issued by the <br />building official upon the advice of the fire chief <br />and subject to such conditions of approval as <br />may be required by the fire chief, except that <br />fireworks permits shall be issued by the fire <br />chief. <br />(d) No fire code permit shall be issued if the <br />permit would authorize an activity or use of <br />property or structures contrary to any provision <br />of the fire code, the state building code or chapter <br />6.12. <br />(Code 1984, § 9.34(5); Code 2003, § 46-33; Ord. <br />No. 287(3rd series), § 3, 12-11-2023) <br />Sec. 5.08.140.
