r <br />N <br />BUSINESS, LICENSING, LIQUOR REGULATION <br />the public generally for entertainment or amuse- <br />ment, which machine emits music, noise or <br />displays motion pictures. <br />Game of skill means any device excepting pool <br />and billiard tables, bowling alleys and shooting <br />lanes, but including miniatures of such places, <br />played by manipulating special equipment and <br />propelling balls or other projectiles across a <br />board or field into respective positions whereby a <br />score is established, the object of which is to <br />secure a special number or numbers or a high or <br />low total score or any other method used to <br />indicate a winner which is available to be played <br />by the public generally at a price paid either <br />directly or indirectly for such privilege, whether <br />a prize is offered for the game or not. <br />Mechanical amusement device includes both <br />games of skill and coin amusement. <br />(Code 1984, § 5.20(1); Code 2003, § 38-601) <br />Sec. 4.20.220. License required. <br />It is unlawful for any person to keep or <br />maintain a mechanical amusement device for <br />use by the public without first having obtained a <br />license from the city. In addition, an annual <br />license fee for each mechanical amusement device <br />shall be required. <br />(Code 1984, § 5.20(2); Code 2003, § 38-602) <br />Sec. 4.20.230. Unlawful use and devices. <br />It is unlawful for any person to: <br />(1) Sell or maintain a machine or device <br />which is for gambling or contains an <br />automatic payoff device; <br />(2) Permit persons under the age of 18 years <br />to play or operate any game of skill; or <br />(3) Permit the playing of coin amusement <br />machines between the hours of 1:00 a.m. <br />and 6:00 a.m, of any day. <br />(Code 1984, § 5.20(3); Code 2003, § 38-603) <br />§ 4.20.330 <br />ARTICLE IV. SHOWS AND SIMILAR <br />PERFORMANCES <br />Division 1. Generally <br />Sec. 4.20.310. Exceptions. <br />The following activities and performances are <br />exempt from compliance with this article: <br />(1) Performances presented in the local <br />schools and colleges, under the sponsor- <br />ship of such schools and colleges, and <br />primarily for their students only. <br />(2) Performances of athletic, musical or <br />theatrical events sponsored by local <br />schools or colleges using student talent <br />only. <br />(3) Any performance or event in, or sponsored <br />by, bona fide local church and nonprofit <br />organizations, provided that such <br />organization shall be incorporated. <br />(4) Any activity or performance more specifi- <br />cally defined and licensed under another <br />section of this chapter. <br />(Code 1984, § 5.25(7); Code 2003, § 38-671) <br />Sec. 4.20.320. Maximum size. <br />It is unlawful for any licensee to admit a <br />larger number of people than the maximum fixed <br />by the council at the time of issuance of the <br />license. <br />(Code 1984, § 5.25(3); Code 2003, § 38-672) <br />Sec. 4.20.330. Overnight camping. <br />It is unlawful for any licensee to permit or for <br />any participant, spectator or customer to camp <br />or sleep overnight at the location of a large <br />assembly. It is also unlawful for any licensee to <br />permit or any participant, spectator or customer <br />to prepare food on such premises unless such <br />person is a concessionaire.
