<br />(c) Exempt organizations. No license shall be
<br />required of any person soliciting for a charitable,
<br />religious, political or educational organization if
<br />such organization is registered with the secretary
<br />of state pursuant to the provisions of Minn.
<br />Stats. § 309.52 as a charitable organization or is
<br />exempted therefore pursuant to the provisions of
<br />Minn. Stats. § 309.515.
<br />(d) Professional fundraisers. Professional fund-
<br />raisers working on behalf of an otherwise exempt
<br />group shall not be exempt from the licensing
<br />requirements of this chapter.

<br />Sec. 4.08.180. Ineligibility.
<br />The following shall be grounds for denying a
<br />license under this chapter:
<br />(1) The failure of the applicant to obtain and
<br />show proof of having obtained any
<br />required county license.
<br />(2) The failure of the applicant to truthfully
<br />provide any of the information requested
<br />by the city as a part of the application, or
<br />the failure to sign the application, or the
<br />failure to pay the required fee at the time
<br />of the application.
<br />(3) The conviction of the applicant within
<br />the past five years from the date of the
<br />application for any violation of any federal
<br />or state statute or regulation, or of any
<br />local ordinance, which adversely reflects
<br />on the person's ability to conduct the
<br />business for which the license is being
<br />sought in an honest and legal manner.
<br />Those violations shall include, but not be
<br />limited to, burglary, theft, larceny, drug,
<br />swindling, fraud, unlawful business
<br />practices, and any form of actual or
<br />threatened physical harm against another
<br />person.
<br />(5) The applicant is found to have a history
<br />of poor business practices. Evidence of a
<br />history of poor business practices shall
<br />include, but not be limited to, the existence
<br />of more than three complaints against
<br />the applicant with the better business
<br />bureau, the attorney general's office, or
<br />other similar business or consumer rights
<br />office or agency, within the preceding 12
<br />months, or within the preceding five
<br />years.

<br />Sec. 4.08.190. Certificate.
<br />(a) Upon the granting of a license, the city
<br />clerk shall issue to each individual employee,
<br />agent, representative, or salesperson a license
<br />certificate. Such license certificate shall contain
<br />a photograph of such employee, agent, representa-
<br />tive, or salesperson, his/her name, age, address,
<br />a brief physical description, the name of the
<br />supplier for whom he/she is an employee, agent,
<br />representative or salesperson, and the trade or
<br />brand name of its goods or services being sold or
<br />promoted by him/her. On the license certification
<br />shall be printed the word "solicitor," "peddler," or
<br />"transient merchant," the valid dates of the
<br />license, and the license certificate number
<br />registered with the city clerk. Every solicitor
<br />licensed hereunder shall have his/her license
<br />certification upon his/her person at all times
<br />while engaged in solicitation and shall exhibit
<br />the same in plain view.
<br />(b) In the case of a license issued to an
<br />organization under this chapter, such license
<br />shall authorize any member of such organization
<br />or any duly authorized volunteer worker the
<br />right to solicit for said organization, provided
<br />that each such member or volunteer worker
<br />shall be required to have a license certificate in
<br />his or her possession, as provided for this in
<br />section.
