0 <br />00 <br />T" <br />§ 4.04.210 <br />ORONO CODE <br />(b) Rates. Where under specific provisions of <br />this article the council has reserved to itself the <br />right to fix or approve fees, rates or charges of a <br />licensed or regulated business, such rates shall <br />be uniform for each category or class of service; <br />and no licensee or proprietor of a regulated <br />business shall claim or demand payment in <br />excess of such rates. <br />(c) Hearing. Any applicant or licensee under <br />this article who challenges denial of a license or <br />rates fixed or approved by the council shall have <br />a right to a hearing before the council upon <br />written request. Notice of time, place and purpose <br />of such hearing shall be given to such persons <br />and by such means as the council may determine <br />in calling the hearing. <br />(Code 1984, § 5.10; Code 2003, § 26-41) <br />Sec. 4.04.220. Insurance requirements. <br />Whenever insurance is required by a section <br />of this article, after approval by the council, but <br />before the license shall issue, the applicant shall <br />file with the city clerk a policy or certificate of <br />public liability insurance showing that the limits <br />are at least as high as required, that coverage is <br />effective for at least the license term approved, <br />and that such insurance will not be canceled or <br />terminated without 30 days' written notice served <br />upon the city clerk. Cancellation or termination <br />of such coverage shall be grounds for license <br />revocation. <br />(Code 1984, § 5.11; Code 2003, § 26-42) <br />ARTICLE III. HOME OCCUPATIONS <br />Sec. 4.04.310. License. <br />(a) Required. It is unlawful for any person to <br />engage in or carry on a Level 2 home occupation, <br />as that term is defined in chapter 6.12 without <br />first having obtained a license from the city. <br />Level 1 home occupations as defined in chapter <br />6.12 are not required to be licensed as long as all <br />conditions set forth in chapter 6.12 are fully met. <br />(b) Regulation. Licenses will only be issued if <br />the specific use is permitted or otherwise allowed <br />by chapter 6.12 and if all conditions set forth in <br />chapter 6.12 are fully complied with. <br />(c) License period. All licenses for Level 2 <br />home occupations shall expire on September 30 <br />of each year. Application for renewal of an <br />existing Level 2 home occupation license shall be <br />made to the city clerk at least 60 days prior to <br />the expiration date. <br />(d) Public notification and hearing. The city <br />council shall hold a public hearing for all home <br />occupations required to be licensed. The owners <br />of all parcels within 350 feet of the property, or a <br />larger area at the discretion of the city, shall be <br />notified ten days prior to the public hearing. <br />(Code 1984, § 5.40; Code 2003, § 26-76; Ord. No. <br />140(2nd series), § 1, 8-28-1995; Ord. No. 221(2nd <br />series), § 1, 9-23-2002) <br />ARTICLE IV. RENTAL LICENSING <br />Sec. 4.04.410. Purpose. <br />The city council finds that to promote the <br />health, safety, and welfare of the residents of the <br />city, assure preservation of the existing housing <br />supply, maintain property values, eliminate <br />substandard and deteriorating rental housing, <br />and maintain a living environment that <br />contributes to healthful individual and family <br />living, it is in the best interest of the residents of <br />the city to require a license for all residential <br />rental property. <br />(Code 2003, § 26-80; Ord. No. 204(3rd series), <br />§ 1, 3-27-2018) <br />Sec. 4.04.420. Definitions. <br />The following words, terms and phrases, when <br />used in this article, shall have the meanings <br />ascribed to them in this section, except where <br />the context clearly indicates a different meaning: <br />Applicant means a person, as that term is <br />defined in this section, who completes or signs <br />an application for a license to rent real estate <br />individually or on behalf of a business. <br />Dwelling means a single-family residence or <br />habitation providing living facilities for one or <br />more persons. <br />Lease means a written agreement creating a <br />tenancy in real property. <br />CD4:8 <br />
