W) <br />M <br />§ 2.04.1270 <br />ORONO CODE <br />be charged again when a house is built <br />on that lot, nor when that house is later <br />expanded. <br />(2) If a lot for which the trunk fee was paid <br />under a past subdivision is then itself <br />subdivided, no additional trunk fee will <br />be charged if the original trunk fee was <br />based on the entire acreage of the parcel <br />now being divided. However, if the original <br />trunk fee was based on an acreage amount <br />less than the acreage of the parcel now <br />being divided, then a supplementary fee <br />shall be required in an amount to be <br />calculated as follows: <br />(Number of new lots being created x <br />base per -lot acreage for zone) - <br />(number of acres originally charged) <br />= number of acres to be charged. <br />(Code 2003, § 14-288; Ord. No. 149(3rd series), <br />§ 1, 5-26-2015) <br />Subdivision V. Stormwater Illicit Discharge <br />and Illicit Connection <br />Sec. 2.04.1310. Purpose. <br />The purpose of this subdivision is to promote, <br />preserve and enhance the natural resources <br />within the city and protect them from adverse <br />effects occasioned by non-stormwater discharges <br />by regulating discharges that would have an <br />adverse and potentially irreversible impact on <br />water quality and environmentally sensitive land. <br />(Code 2003, § 14-301; Ord. No. 56(3rd series), <br />§ 2, 4-13-2009) <br />Sec. 2.04.1320. Findings. <br />The city council hereby finds that non- <br />stormwater discharges to the city's municipal <br />separated storm sewer system are subject to <br />higher levels of pollutants that enter into receiv- <br />ing water bodies adversely affecting the public <br />health, safety and general welfare by impacting <br />water quality, creating nuisances, and impairing <br />other beneficial uses of environmental resources. <br />(Code 2003, § 14-302; Ord. Administration. <br />The city and its authorized representatives <br />are authorized to administer, implement, and <br />enforce the provisions of this subdivision. <br />(Code 2003, § 14-303; Ord. Illegal disposal and dump- <br />ing. <br />(a) No person shall throw, deposit, place, leave, <br />maintain, or keep any substance upon any street, <br />alley, sidewalk, storm drain, inlet, catch basin <br />conduit or drainage structure, business place, or <br />upon any public or private land, so that the same <br />might be or become a pollutant, unless the <br />substance is in containers, recycling bags, or any <br />other lawfully established waste disposal device. <br />(b) No person shall intentionally dispose of <br />grass, leaves, dirt, or landscape material into a <br />water resource, buffer, street, road, alley, catch <br />basin, culvert, curb, gutter, inlet, ditch, natural <br />watercourse, flood control channel, canal, storm <br />drain or any fabricated natural conveyance. <br />(Code 2003, § 14-304; Ord. Prohibition of illicit <br />discharges and connec- <br />tions. <br />(a) No person shall cause any illicit discharge <br />to enter the storm sewer system or any surface <br />water unless such discharge: <br />(1) Consists of non-stormwater that is <br />authorized by an NPDES point source <br />permit obtain from the MPCA; <br />(2) Is associated with firefighting activities <br />or other activities necessary to protect <br />public health and safety; <br />(3) Is one of the following exempt discharges: <br />water line flushing or other potable water <br />sources, landscape irrigation or lawn <br />watering, diverted stream flows, rising <br />groundwater, groundwater infiltration to <br />storm drains, uncontaminated pumped <br />groundwater, foundation or footing drains <br />(not including active groundwater dewa- <br />tering systems), crawl space pumps, air <br />CD2:24 <br />
