M <br />N <br />§ 2.04.550 <br />Sec. 2.04.550. Private water supplies. <br />•101\• •OI <br />No water pipe of the city water system shall be <br />connected with any pump, well, pipe, tank or any <br />device that is connected with any other source of <br />water supply; and, when such are found, the city <br />shall notify the owner or occupant to disconnect <br />the device, and, if not immediately done, the city <br />water shall be turned off. Before any new con- <br />nections to the city system are permitted, or at <br />the time such new connection is inspected, the <br />city shall ascertain that no cross connections will <br />exist when the new connection is made. When a <br />building is connected to city water, the private <br />water supply may be used only for such purposes <br />as the city may allow. <br />(Code 1984, § 3.10(5); Code 2003, § 14-135) <br />Sec. 2.04.560. Regulating the use of water <br />during periods of water <br />shortage. <br />(a) Purpose. In order to avoid a water short- <br />age due to inadequate capacity in water systems, <br />to ensure an adequate water supply for fire <br />protection, to protect the environment of Lake <br />Minnetonka, to ensure the protection of subter- <br />ranean aquifers, to maintain the quality of <br />domestic water supplies, and to protect the <br />general health, safety and welfare of the residents, <br />the regulations on nonessential water uses <br />prescribed in this section shall apply during <br />periods of water shortages. <br />(b) Implementation of restrictions. Whenever <br />the city council shall determine that a shortage <br />of water threatens the city, it may enact by <br />resolution the restrictions for nonessential water <br />use set forth in this section. The resolution shall <br />become effective 24 hours after passage and <br />publication. The resolution shall contain the <br />following information: <br />(1) Uses of water that will be restricted; <br />(2) Types of water supply which will be <br />restricted, such as the public water <br />system, private wells, lakes or other <br />surface water systems; <br />(3) Times during which the restriction will <br />apply; <br />(4) Whether the use restrictions will apply <br />to all property in the city or will vary <br />depending upon location or identification <br />of property; <br />(5) When the restrictions will be implemented <br />and when they will terminate; and <br />(6) Whether the restrictions will be voluntary <br />or involuntary. <br />(c) Notification of public. Whenever the city <br />council enacts the restrictions in this section, it <br />shall take such action as is reasonably practicable <br />to notify the general public of the restrictions. <br />The notice shall be posted on the city's bulletin <br />board and shall be published in the local <br />newspaper. The notice shall include the informa- <br />tion described in subsection (b) of this section. <br />(d) Types of water supply. The restrictions in <br />this section shall, at the discretion of the city <br />council, apply to the public water system, private <br />wells, lakes or other surface water systems, or <br />any combination. <br />(e) Restrictions. <br />(1) During a water shortage, the city council <br />may order one or any combination of the <br />following restrictions: <br />a. A complete or partial ban on water <br />use for watering lawns, trees and <br />shrubs, irrigation, car washing, fill- <br />ing swimming pools, air condition- <br />ing, other uses determined by the <br />city to be nonessential, or any <br />combination; <br />b. An oddleven watering ban in which <br />residents of addresses ending in an <br />even digit may water on even - <br />numbered calendar days and <br />residents of addresses ending in an <br />odd digit may water on odd - <br />numbered calendar days; <br />C. A limitation of water use for speci- <br />fied hours of the day; <br />d. A voluntary or involuntary restric- <br />tion; <br />e. A use restriction applicable to all or <br />part of the city or based on land use <br />or property identification; and <br />CD2:12 <br />
