ti <br />T <br />T <br />§ 2.04.120 <br />(2) <br />(3) <br />(4) <br />(Code <br />ORONO CODE <br />filing the petition), and the reasons neces- <br />sitating the proposed increase or increases. <br />Such petition shall be filed with the <br />council by serving the petition on the city <br />clerk in person or by certified mail, return <br />receipt requested. <br />Within 30 days of such filing, the council <br />shall adopt a resolution and serve the <br />resolution upon the resident <br />superintendent of the franchisee in like <br />manner as the petition may be served, <br />either approving the proposed increases <br />or ordering a hearing to be held within <br />60 days. If no such action is taken by the <br />council, such increase shall take effect on <br />the date stated in the franchisee's peti- <br />tion as though approved by the council. <br />Prior to the hearing date, the franchisee <br />shall, without delay, comply with the <br />city's reasonable requests for examina- <br />tion and copying of all books, records, <br />documents and other information relat- <br />ing to the subject matter of the petition. <br />Should the franchisee unreasonably delay, <br />fail or refuse such requests, such action <br />shall be grounds for a continuance of the <br />hearing date. <br />Notice of hearing shall be in the form and <br />manner stated in the resolution. At the <br />hearing, all persons wishing to be heard <br />on the matter shall be afforded a reason- <br />able opportunity. Findings and a deci- <br />sion shall be made by the council within <br />15 days after the hearing and served <br />upon the franchisee. <br />1984, § 3.03; Code 2003, § 14-37) <br />ARTICLE III. CITY UTILITIES <br />Division 1. Generally <br />Sec. 2.04.210. Ownership of municipal <br />utilities. <br />Ownership of all municipal utilities, plants, <br />lines, mains, extensions and appurtenances shall <br />be and remain in the city; and no person shall <br />own any part or portion of the utilities. However, <br />private facilities and appurtenances constructed <br />on private property are not intended to be included <br />in municipal ownership. All private extensions <br />of public utilities shall be constructed and <br />maintained in accordance with city standards. <br />(Code 1984, § 3.05(4); Code 2003, § 14-71) <br />Sec. 2.04.220. Municipal utility service <br />outside the city. <br />The city administrator is authorized to furnish <br />municipal utility service to consumers outside <br />the city, provided such consumers specifically <br />agree to all the terms of this Code, including, but <br />not limited to, rules, regulations and rates adopted <br />under this Code and the right to specially assess <br />delinquent services, charges and penalties. <br />(Code 1984, § 3.05(10); Code 2003, § 14-72) <br />Sec. 2.04.230. Right of entry. <br />The city has the right to enter in and upon <br />private property, including buildings and dwell- <br />ing houses, in or upon which is installed a <br />municipal utility, or connection with a municipal <br />utility, at all times reasonable under the <br />circumstances, for the purpose of reading utility <br />meters, for the purpose of inspection and repair <br />of a utility system, or any part of the system, or <br />public or private connection with the system, <br />and for the purpose of connecting and disconnect- <br />ing service. <br />(Code 1984, § 3.05(5); Code 2003, § 14-73) <br />Sec. 2.04.240. Application, connection and <br />sale of service. <br />Application for municipal utility services shall <br />be made upon forms supplied by the city, and <br />strictly in accordance with such forms. No con- <br />nection shall be made until a permit has been <br />issued by the city to a licensed plumber and <br />consent has been received from the city to make <br />the connection, and all fees, charges and assess- <br />ments required by this chapter have been paid in <br />full. All municipal utilities shall be sold and <br />delivered to consumers under the then applicable <br />rate applied to the amount of such utilities taken <br />as metered or ascertained in connection with <br />such rates.
