<br />the water;

<br />biological, thermal, or physical condi-
<br />tion, in any surface water or stream

<br />f. Degrades the quality of groundwater;
<br />or
<br />g. Harms human life, aquatic life, or
<br />terrestrial plant and wildlife.
<br />(2) The term "pollutant" includes, but is not
<br />limited to, dredged soil, solid waste,
<br />incinerator residue, garbage, wastewater
<br />sludge, chemical waste, biological materi-
<br />als, radioactive materials, rock, sand,
<br />dust, industrial waste, sediment,
<br />nutrients, toxic substance, pesticide,
<br />herbicide, trace metal, automotive fluid,
<br />petroleum -based substance, and oxygen -
<br />demanding material.
<br />Pollute means to discharge pollutants into
<br />waters of the state.
<br />Pollution means the direct or indirect distribu-
<br />tion of pollutants into waters of the state.
<br />State designated water uses means uses speci-
<br />fied in state water quality standards.
<br />Storm sewer system is a conveyance or system
<br />of conveyances that is owned and operated by
<br />the city or other entity and designed or used for
<br />collecting or conveying stormwater.
<br />Stormwater means precipitation runoff, storm -
<br />water runoff, snow melt off, and any other
<br />surface runoff and drainage.
<br />Provisions of this chapter relating to municipal
<br />utilities shall constitute portions of the contract
<br />between the city and all consumers of municipal
<br />utility services, and every such consumer shall
<br />be deemed to assent to the same. All contracts
<br />between franchisees and consumers of utility
<br />services other than municipal shall be in strict
<br />accord with the provisions of this chapter.

<br />ARTICLE II. PUBLIC UTILITIES
<br />Sec. 2.04.110. Underground utility
<br />construction.
<br />(a) Underground construction required. All
<br />utility lines installed, constructed or otherwise
<br />placed within the city for electric, telephone, TV
<br />cable or other like or similar services to serve
<br />residential, commercial and industrial custom-
<br />ers in newly platted areas, and which utilize
<br />metallic conductors to carry electric current,
<br />whether owned, installed or constructed by the
<br />supplier, consumer or any party, shall be installed
<br />and placed underground, subject only to the
<br />exceptions stated in this section; however, above-
<br />ground placement, construction, modification or
<br />replacement of meters, gauges, transformers,
<br />streetlighting and service connection pedestals
<br />shall be allowed. The requirements of this sec-
<br />tion shall apply equally outside of the corporate
<br />limits of the city coincident with city jurisdiction
<br />of platting, subdivision regulation or
<br />comprehensive planning as may be allowed by
<br />law. All companies installing and operating lines
<br />such as those described in this section shall be
<br />referred to as utility companies for purposes of
<br />this section.
<br />Surface waters means all waters of the state
